You could be stuck because of background/name check. Check my previous postings where I sent a link to one of the documents someone posted when they got is using FOIA. At the time of final approval also some checks are initiated and that could cause delays also.
I got the SLUD on 9/3, 9/4, 9/7 2010. Showing the same message under review.waited all these days hoping for good news.No good news.called c/s(customer service),got response that they only "touched your file on 9/3,but don't have idea what IO did."
Came to US more than 10 Yrs before.still waiting.

It’s more than 90 days but I didn’t even get the Receipt Notice for said application. How I can get the EAD in 90 days per law when i didn't even get the Receipt Number from USCIS?

I said this before (and it was deleted, and now I cannot even post a new thread.. I am all green on post, lol). Everyone has his/her own interest, to make the IV work, we have to work together, donation or not, effort or not... all the time, writings ppl put here are contributions....

We rode the same wave even last year with many of the same Guru;s predicting the same movement to 2007 and what we saw 2 weeks movement . There was one person called QSHEMK who after that went completely out of the picture or has rejoined with a new name .
Also I have analyzed that people who have a date in 2008 somehow predict that the dates might move to 2008 and people who have a PD of July predict that dates will move to August . This is just an observation and nothing more , and if you go through the threads thats exactly what you will see.
I will be equally benefited as you all will if the predictions come true , but be well prepared for a major heartbreak also like last year .
While it takes a lot of effort from some of the members to crunch such numbers I would be first to extend my sincere gratitude to them for doing this , I would also recommend you all to take the analysis and predictions with a grain of salt and not to raise your hopes too much on these predictions.
It has seldom worked for the last 6 years at least . Hope it does this time . I speak from experience in IV since 2006.

If they were submitted on 8/30/ and it's not cleared yet and your derivatives are cleared then more than likely you are stucked, there is some probability that you might be cleared in few weeks depending on number of hits generated against your name and avaialibility of the documents needed to be refered by fbi to clear you. However you dont need to worry much because now a days fbi seems to getting work lot faster then it used to. Also since july fbi has increased the fees that they charge USCIS to do the check which has increased the staff at NNCP and so the efficiency. I would suggest for you to wait 60 days and try again. Hopefully you have good news. I have been waiting 35 months.

After filing I-485 one single thing which gives butter-flies is NC. Just a Look at your and CAdude posting shows how terrible is NC and how difficult it is for those unlucky ones to bear this uncertainty. God bless all !!!

Its not that I think I am smarter or have any additional insight...but I take things at face value. Of course the total number of pending cases in the chart and in the PDF should match - they both are exactly what they say they are "PENDING EMPLOYMENT BASED I-485 cases" If that's what the report title says, that's exactly what it means. No point in over-analyzing if this is just for pre-adjudicated or only primary applications etc....
I say stupid questions because people still ask "Does the PDF report contain numbers for dependents or only for primary applicants" - so you are telling me that this is not clear from the PDF report??

There will be only 25 - 20k Spill for 2010. Given that India and CHINA Eb2 can cross mid 2006.
It will take another 2 years for Eb2 to make C and then we can see Spill over to Eb3.
If economy improves and we start seeing labor approval coming Spill be going to less and creating more wait time.
Eb3 needs VISA RECAPTURE badly. Eb2 guys can wait for couple of years to get GC. but still 2-3 years in given economy is too risky. Bottom line is WE need VISA RECAPTURE in order to clean all mess.

I have decided to use AP and have cancelled my appt in Chennai.
I have an appointment at Kolkata on the 11th. Scheduled to fly back to US on the 26th. Considering Martin Luther king Jr day it will be 9 working days. After seeing the PIMS delays, I am seriously considering return back on AP. Cannot take the risk of delaying the flight as I dont have vacations to hang around and wait for PP.

I still think, the USA is the best place for democracy loving people. Govt and its agencies try their best to be accountable to law. Now if you want our Immigration issue to be put before IRAQ in the Congress, I would think that is selfishness. I have colleagues whose sons are in IRAQ. For me their lives are more important than my GC. Now that does not mean we stop making our point to Congress.
PRECISELY My point. First it is IRAQ, then it will be the Presidential Elections then something else. The Government has NO time to question the USCIS and NO real motivation either.

I am planning on applying as a dependent using my wife's 485. I already have one 485 application. My question will it affect my wife'e processing. I am not so worried about my processing, if it gets delayed so be it. Also I think the chances of I getting two A# is slim bcos i would mention my A#, in my new 485 application.

I am saying there are problems with USCIS not just the one you are pointing out.
My point is if more and more people like you file lawsuits against USCIS for the different kinds of injustice they think USCIS, DOL and DOS had brought on them, we ( all EB categories)will be in better shape to fight together for the bigger cause which is more predictable process and processing and closing as many loopholes as possible in the employment GC journey.

As I am continuing calls I found that they are all aware of bill coming for vote tomorrow. They asked are you talking about visa bill?
Generally the response from Dems is positive and from Rs it is sort of neutral.
Rep. Coble's (NC) spokeman insisted that I was not from NC. When I mentioned that I lived in NC for many years mentioning the names of the towns, his reply was that those places were not from their district.

Then post it as a reply to every Lou Dobbs video posted on you-tube.

I just spoke with Xiyun Yang from Washington Post and conveyed thanks for covering a detailed article. She expressed that there is attention being drawn by many quarters including political for "Skilled LEGAL Immigrants".
Also we need to emphasize & communicate is the "increased fees" (almost doubled in many cases) for all USCIS services effective end of this month (July 30). Is this the penalty to be legal ?
The rallys and campaigns should emphasize this important detail too. This is huge money and not fair to the amount of service that is being currently provided.

Further, as there are still cases not owned by any center, weekly updates are misleading. Each center just reports on what it has accepted to deal with. This needs to be addressed as well.
