Friends...
I am considering move to a different state in few months (work from home) keeping my existing job for health reasons... My employer has been nice to me.. so Iam not considering changing job for now... My concerns,
1) Will this situation cause compulsary RFE? Anything I need to be careful of?
2) Do I need to invoke AC21 or just amend my H1 or start using EAD? What is advisable... Any personal experience??
3) Can I claim moving expense (when filing taxes) if moved with same job??

hi guys,
i have a 485 filing question. i'm on EB2, ready to file for 485. however, i am in india on a family matter and will have to return only for the filing. i know it is "sooner the better", but i am trying to figure out how late i can return to US.
i have read on this forum that dates will retrogress in august. any informed people out there know how likely that is?
also, if i have to make it there in july to file 485, any idea about how long after filing i need to stay in the US before i can return back to india? i mean, any rules which say you cannot travel before such-and-such happens?

No one can tell you what will happen next month or 2 months from now.The best day to file 485 is July 2nd.
Once USICS receives your app they will send out a document for finger printing.You should take a infopass appt and go to a local USCIS office to be finger printed.
The time frame to receive this document ranges anywhere from a month to 2 or more.

How will removing country limits help China, India and ROW.
Has someone done any calculations on visa date movement.
We should have some comparison on this because some of us from China against. I seen many ROW against.
Does it help only Indians or everyone by how much?
I see these calculations bringing Indians, Chinese and ROW together.
the truth is this.... some of the chinese are against removal of country limits becoz they do not care if it helps them..... they r simply opposed to removal of per country limits becoz they cannot see india getting any benefit..... its the age old chinese mindset which cannot be changed with numbers or calculations...... otherwise just think for u'rself...... if china is retrogressed as evident from monthly visa bulletin .... & removal of per country limits will create 1 queue for everyone..... then y would some of these chinese be opposed to the removal of per country limits.....

You will get the extension from the CIS here. You will only need to go to Canada if you want the visa stamped on your passport.

There is no need to withdraw your 485. But why do you need 2 485's. It just shuts out visas for others. You can continue on H1b with your current employer and join in EAD with the other.

Please note that an I-485 approval invalidates the H-1B visa.
I would travel to the US before Advanced Parole expiry to obtain the GC and return. I am not sure of any exceptions - please post the question in 'Ask a Lawyer' section ASAP.

Bob is right. Don't buy anything from any camera shop in Brooklyn. Those package deals are not deals at all. I selected H1B: SPECIALITY OCCUPATION as that was the manner i last entered the country in Dec 2007. Even though i have an AP(haven't used it) but for my wife(who entered on AP) i selected DA: Advance parole. So if you used AP at POE then your status is DA. Hope that helps :)

He/She can join old company as long as H1b from the old company is not revoked. There is no need for any H1b transfer as long as old company's H1b is valid. Just go and join them back if they are willing to take him. Lot of people of H1b do this. Hope this helps.

My attorney by mistake has applied for my ead renewal 10 days before the 120 time frame. I was supposed to send my application to USCIS by June 20th but my attorney sent it today and did this by mistake. can the gurus please explain me my options. i would hate to miss the line for being diligent. do they reject my application and if so will they send it back. can i apply a new app before i get this application back or do i have to wait till it comes back (if it comes back). what other negative implications should i be worried about.

I am currently residing in US on H-4 visa. My husband is on H-1 visa and our Green Card processing is in progress - our
I-140 has been approved. Our priority date is in May 2008.
The current "priority dates" for EB-3 as per USCIS is April-2001. Based on this, When can we expect our "485" to be filed and our EAD to be approved ?
I have a law degree from India (12+3+3) and currently I am pursuing a paralegal program from an ABA approved university. I might loose my job oppurtunities if I don't have a work permit. Is there anyway that I can get a work permit with my pending GC application process, without hampering the GC process ? Can I get a work visa (or EAD) based on my education ?

I think the processing time for I-485 at NSC is complete BS. Its hard to believe that they have pre-adjudicated all the employment based applications received in July-Aug'07.
