Some IV members were in DC at USCIS building yesterday (Tuesday, July 10th, 2007) from 10 AM to 1 PM. There were reporters there including CNN-IBN and Voice of America (Aaj Tak chanel) with video cameras. We saw the deliveries of flowers being made by UPS and FedEx. The DHL guy told the flowers were already delivered in the morning in the big truck. The security guards at the loading dock of USCIS were not allowing Video Shooting after the reporters shot the UPS deliveries going inside. When the FedEx tuck came in, they made him park right near the Loading Gate and were trying to cover up by parking two other vans each side of that truck so nobody can shoot the delivery.
Then IV members went inside the USCIS building from the main gate to hand deliver the flowers with Get Well Soon ballon and card for Emilio Gozales. Teh Video cameras followed until the security guard asked them to stop the recording as they didn't have prior approval. The security guards, receptionists and people around were smiling by seeing the flowers for Gonzales. They let the IV members proceed towards the visitor area. Where another secuirity guard asked who the delivery was for and directed to one of the Gonzales's secretaries, Rachel, who accepted the flowers. There were people around her. Rachel said to them "This is creepy, as far as I know he ain't sick, we received flowers last week, they were pretty too. Yesterday someone sent him cookies. This is some kind of peaceful protest". Then she also read the card in front of IV members. IV members asked her about the website update which says they are sending these flowers to Walter Reed. She said yes, we are doing that. IV members thanked her and left the building.
On the other side, the reporters with cameras were asking for approval to shoot inside. They made them wait and then several people (from different level of securityty to management) came to talk with them and finally said they can not allow to shoot for security reasons. The reporters also didn't miss to ask them about flowers campaign and apparently sent the message and hype about the campaign to top level.

I do understand that without evidence you can't fight the conventional way or file a law suit. It would be difficult, if not impossible. I am not debating that. I never said it would be easy. Even with evidence (in case of Capital One), one can argue if thats a good enough base for fighting and whether it will do any good if the case is won. Thats not the point.
What would you do if a recruiter or employer told you (verbal or writing) that it is their policy not to hire Indians? (I am just using India as an example).
Regardless of written evidence, I would be inclined to do something about it. I am not saying that I will file a law suit. I would probably not even want to work for such an employer. But I will not be speculating that oh, there must be some loophole that allows employers to have such a policy; because many of them are saying that, it must be legal. I will not assume that they can do this under "Hire and fire" authority. We just seem to have a little difference in opinion about that. We agree on pretty much everything else. Thats all. And frankly, its good to have an opposing perspective on things.
Now, if I hear from experts that my understanding of the discrimination laws is incorrect and that it is legal for an employer to say that they will not hire somebody with EAD, I'll just shut up. Until then, I will encourage people not to be quiet and to call the hotline, file a complaint, call the media, and pursue whatever means we have at our disposal to fight what we consider injustice and fight what we believe is discrimination as per the law.

Because even with this detailed information on the mechanics of immigration legislation, we cannot figure out who is friendly and who is not and who to lobby to and who to ignore.

When you want to join vonage or customer you will have good exp. Try to cancel or select the option to cancel and see.
I signed up online after one my friend referred me to this plan but unfortunately I have not used their referral link. I called customer service after getting my phone and told them my friend's number and they are saying that since I did not go through the right link, we both won't get the $49 until after I complete the 3 months. And I won't get it if I forget to call them after 3 months. I am wondering if I should cancel and send them back the router and order online through the referral link.

I received a phone call (WOW!) from a sweet lady from CIS Ombudsman's office. I sent letters to his office and in the letter I mentioned my cell #. Anyway she wants a real person who got deniel. I told her that my friend got deniel (IVens are my fried). Anyway, she sent an email too after I asked her to give her info so that my friend can send her his case details. Today is my day. After 13 years into this country, finally I am green. I tried SR, Senator help, infopass without much help. 2 days ago when called, Texas POJ, one nice IO told me case is not yet assigned to officer, will send email, looks like worked this time. I just talked to them. Rep said they can not match vonage offer.... I am already paying teleblend around $16 per month. I see no reason why I should not pay $9 more to Vonage in order to get Unlimited India Calling plan. (As I also spend atlest $20 - 25 on reliance india call additonally.)

My case is at the local USCIS service center. I opened an SR on Aug 12 and got an email response encouraging me to apply for an Infopass appointment: "We have determined that your case would have a better result if you make an appointment to visit your local office, so you may speak with an Immigration Services Officer about your case."
I now have an Infopass booked. Let's see what happens. My case is pre-adjudicated since we had an interview two years ago.
Should it go any further this way, can anyone please explain the process of Ombudsman / Congressman / Senator et al?

Not an issue. It can be done using business necessity letter. Companies like Google should not have a issue as they regulary higher such qualified people. On the other hand , the non genuine case will have difficulty as from now onwards these positions will be scrutnized more closely. Moreover, any indication of fraud may result in the the audit of original labor also.
Not only consulting companies but genuine companies in the software arena will also face trouble. If I interpret it correctly, most new hires at places like Google, MSFT, Amazon etc. even if having MS from top-notch universities in the US can apply only under EB-3 as their job description will fall in Job Zone 4.
On the other hand somebody having a non-IT or CS degree from a mom&pop University can find a job, state its "research" and upgrade to Job Zone 5 and apply under EB-2.
I wonder how this will fly with the affected companies?

I am planning to take up a EB3 labor substitution case, and I have a few questions.
With the I140 premium processing being eliminated from today, and the current I140 processing time taking 9 months my question to you all is:
a. Suppose I apply for my I140, I485, AP today (say May 18th 2007), will I be eligible to get an EAD in the next 90 days, though my I140 could still be pending.
b. Will the time for AC21 portability start from the day I applied for I485 or from the day the I140 will get approved.
c. Suppose me and spouse get the EAD (despite I140 pending), and spouse converts from H4 to EAD while I stay on H1-B, what happens to the spouse status in case the I140 gets denied.
d. What is the possibility of the EB2 VISA dates moving further.
Appreciate your help in understanding the system correctly.

Well, all the jobs you mentioned in your message now falls in Zone 4 i.e. Eb3.
Only option that person may have now is to change career altogether in the fields where desi consulting companies do not operate.
Its not so simple though. Even after finding a good company to stick to, you should not make up your mind to remain stagnant. When you work for about 5 years, you will be faced with a situation where you are asked to take on more responsibility.
The way things are with the current process, if you want to progress in your career and take on a new challenge (eg: database programmer to a DBA/architect), that would require a new LCA since there is a significant change in the responsibilities.
Also at big companies, there are several lines of businesses which are structured as if they are companies by themselves. If you want to shift between LOBs within the same big company, that would also require a new LCA.
