Lawyer is sharing info that some of their client have got fee invoice from NVC. I have done family based application through NVC for my parents and I know you get fees invoice almost 4 months prior to your GC interview date. So lawyer is thinking that NVC is thinking to go upto Nov 2007 in case if CIS fails to act on enough cases in last months.

They generally request payment for cases that are within a certain interval of being current. For example, yesterday, we received a fee bill for an India EB2 case with a September, 2007 priority date that has been pending at the NVC for several years.

1st H1 valid until Sept 2008.
Consultate for CP will be Mumbai, India.
I have a couple of questions pertaining to GC.
My LC is approved 2 days back (Filed - May 17, Approved - May 25) I didnt know this happens so fast. We have not yet received the cetitified documents from the department so I dont know whether its EB2 or EB3.
My lawyer says it is upto the department to decide whether my case comes under EB2 or EB3? Is this right?
Now we plan to file the I-140 in June 07. Should I go for premium processing right from the first time? My company is ready to do this. But someone said on one of these websites that this creates a suspicion in the minds of the department. I dont know how true this is?
I am thinking to opt for Consular Processing. What do you recommend on this?

I am really surprised by the meek response...what is wrong with everyone?? We have just abt 54 letters so far and almost 200 members online right now !!!
If you are reading this but have not written a letter yet, please answer one question for me:
What is the least effort that you can put towards your immigration?
If you cannot write or type a letter, i'm afraid you don't belong to the "Hard working, highly skilled" immigrants that is being referred to in the letter.
Please send me a Private message with your name and deatils and I can write up and post a letter for you....its is actually going to be for me as I am benefitting from this campaign...i don't mind if you get the benefits in the process.
I have the capacity for 3 hand written letters per day...and I am dead serious. We need numbers and a meagre 100 letters are going to get lost amongst thousands of letters that are received at Whitehouse everyday.
People got used to Drive through mentality.

While filing for I 485, I was wondering if I can file for my wife's EAD and AP and dont apply for mine (at this time) as I am not going to change the job in next few months. So I will keep working on my H1 (valid till 2009) and she can work on her EAD? Is it possible and legal to do ?

Hi All,
I got the I-485 approval/welcome notice from USCIS for myself and my spouse today. But the wierd thing is that my NSC online status still shows RFE response received and case pending (from 2008)...the welcome notice says I should expect to receive the card in 3 weeks...guess I am greened.
Anyone else face a similar situation?

This is what i am doing to call a cell phone or any land line in india. Vonage has a call forwarding feature. Simply log in to your vonage account and go to features and configure the call forwarding feature.Configure such that the call is forwarded after 20 sec's. Intially vonage rings and after that it is forwarded to the india cell or landline forwarding number. Its free of charge as calling from vonage to india #'s is free. Hope this puts the debate to rest.
Why do I need to do all this stuff to call india cell or landline I can do that as such directly through vonage device. My question is how do we call from our mobile to india mobile through vonage. Lingo gives the feature of calling from your mobile number to an indian landline but not indian mobile. I am not sure if your way solves this problem.

Accordingly, it appears the AC21 law did not intend to change the prior law, which only requires a future job offer with respect to the GC sponsorship in employment-based cases. Please refer to the disclaimer at the end of this page, since, at the time of this writing, the regulations have not been published.

I would like this idea to materialize but I am just wondering how it is practical.
Except for waiting for a visa number to be available all other delays are due to the time that it takes to process a case (and also due to the country quota). In labor stage, DOL determines if there is any citizen who fit in the labor description and who is looking for a job. In 140 stage, USCIS determines if the company is in good standing and has the ability to pay. In final stage, the candidate’s biometrics is taken and his background checked. All these are essential process in adjudicating a GC case in the employment category. I just do not how all these can be surpassed and candidates handed over a GC, let alone citizenship.
Allocating recaptured visa numbers and following a sensible order is more practical in eliminating some of the delays…

It is economy. DOL vitually halted PERM approvals. Companies are not sponsering GCs as they used. If you give an Ad today, you will get 10 times resumes. So there is no easy way to get an approval.
I think we are assuming that this will continue to be the case through Oct 2010. What if DOL changes policies with PERM approval tomorrow or the economy starts improving by March? EB2 ROW is current and there will be quite a few PERM's from them which will be adjusted immediately. We'll have to wait till the Sep results are in and the data is adjusted with 2005 EB2 numbers. Hopefully all < 2005 should be taken care of for EB2.
