Yes it is a concern that I have to address. However I see 2 ways to work around it.

1. Travel out of country get H4 stamping done based on my current H1B status

or

2. I apply for I-485 and add my wife later to the application when we have received her H4. In this case, once I have applied, I can add my wife to the application even if the dates are not current at that time.


If I were you and my priority dates were current, I would go for 1 above [get H-4 stamped ASAP and enter in US and apply for I-485].

If you were current for June and if the USCIS received your application in June, then you are 100% fine. USCIS stamps the "received date" on the package. So when they open it for processing (1,2,3 weeks later), they will see that your PD was current when they received it.

Of course, if your PD is not current when they open it, then of course, your 485 won't be approved. But you will get your EAD and AP.

P.S.: Note that there is some disagreement about whether the USCIS looks at the date they received the package or the date your package is post-marked.

I think the company should be filing the fees but lawyers fee for filing is not their liability.

I am paying for everything including filing fees. I thought that the company is no longer involved once you are through the I-140 stage.

I started from below and tried twice which went to VM . All of them took message and Thanks. Since they are getting many calles, Most of them not transferring to other person, Front desk person itself taking message.


Took 45 minutes to cover all of them but time well spent. GO IV GO...

My priority date is March 26th 2006 and current for month of September.
I created a SR on 09/14 and got the following response today.

"

USCIS and or DOS don't quiet yet understand the full implications of this flower campaign. They still are feigning ignorance or adamant in their analysis of the july fiasco.

Untill this flower campaign is further carried by major newspapers, we still cannot declare full victory.

Yes, USCIS chief fully knows that flowers were sent as a token of protest and they will not know the full impact untill they see them.


I am telling you guys, the USCIS is gonna SERIOUSLY think "Lets keep screwing these guys and getting free stuff AND free publicity"

Of course, person on L1 status can work at client site as long as he/she is directly managed by company that has sponsored L1 visa. They can not be directly managed by client. That is the restriction. Have you even read posts in this thread?

FYI, there will be a manager from TCS/WIPRO/IBM side to whom all these L1s will be reporting... This shows your poor understanding of how an Indian company is being operated...
They will "work" with client MGRs but report to employer MGR....:D

If the rumor turns out to be true in two days, I strongly believe it's a conspiracy.

When the CIR was revived, there was a strong feeling that the senate will pass based on the negotiations. Since CIR is horrible for those who are currently in line(including us), somebody/some group panicked and triggered the bulletin.

Now that CIR is officially dead and buried, status-quo is OK, so thought that somebody/some group.

Oh well....
I only pity the H4s out there.

This is really good news.. Can you please provide more details of your case?

- was it first H1/H4 stamping or renewal?
- do you have I140/I-485 application filed?
- did your employer do anything to inform the US consulate in advance about visa stamping?

H1 Visa renewal (with a new employer)...earlier H1 visa was stamped in Toronto.
I-140 pending at NSC since March 07
Category is Schedule A (now EB3)
I-485 pending at TSC, EAD and AP approved.
There was no communication between the consulate and my employer. I guess it was just luck.

Don't bother to ask anything about CP for people just don't care to respond!

I have tried enough on every forum including this (even whe we need a genuine information and not just predictions).

No one to be blamed! But relax, there will be a time for CP guys too!

Maybe people are not responding on the basis that they do not have any knowledge of consular processing.

I think majority of people on this forum are in the US and are adjusting status. Surely you would not want answers that were wrong or misleading.

Friends,

Finally we got our receipt numbers today from the Check Images. Our Application reached USCIS on 07/03 by USPS Mail. Don't know who signed it. Have been waiting for it patiently. All our receipt numbers start with SRC so from Texas. My I140 was approved form Texas and there was an LUD on the I140 on 07/28.

All the best for whom ever is waiting for the receipt numbers. You guys should get it pretty soon.

I am july 3rd filer, still waiting for receipt. In your e-mail you said there was LUD on your I-140 date 07/28. What it means...did you file I-140 and I-485 together? is there any connection in getting receipt of I-485 and LUD on I-140, just curious becasue I am also seeing LUD of 07/28 on my I-140 but my I-140 got approved in 2006.

If you want only India calling, there are lot of good calling card companies, that they are offering better price than the above mentioned.

Airtel call home - 9.99 + tax = you will get 600 mts - 45 days validity period
relaible calling - 9.99 +tax = you will get 600 mts - 30 days validity period

I am not talking about calling cards. ALLVOI is also a VOIP service like Vonage and has the same deal on free US calls etc. However, their India pkg is much better IMO.
