    It was on Dec 2005 . Luftansa . Chennai - Frankfurt- Dallas . I was waiting for my boarding pass . I handed over my e ticket to the lady at the counter. Instead of issuing the boarding pass , she asked me about my H1B papers. I got confused . Why should I show my papers to this lady ? . Since it was my very first trip to US , I meekly showed her my papers.After that she had issued the boarding pass.

    Friends, you may think I am very meek.This was not my first overseas trip. I had visited Japan previously. I didn't want to have fight with her and start my journey in bitter taste from the beginning.

    Don't think only Non-Indians treat Indians shabbily. Our enemy is within.

    If I happened to see that lady once again in Chennai -------

    USCIS will be liable to pay the expenditure incurred by each applicant (laywers fee, medical exam fee, cancelled air tickets etc) and not to mention the mental stress caused by this whole episode of renegging on their visa bulletin.

    They should have done in the last week of June instead of waiting for july 2nd monday.
    Technically all those applications that will be in the mail before the fresh visa bulletin on monday or tuesday has to be honoured by USCIS come what may.

    If not, they will have to face lots of legal cases not to mention the embarassment of incompetency of these USCIS employees.

    Let us pool together money for a legal case.

    I think we should concentrate on things which are beneficial for everyone - not only EB1-2 or 3 . We should get USCIS to improve efficiency, use all visas, get applications processed according to their PD and not randomly and above all do away with the country limits which is the biggest cause of this retrogression.

    When there are so many big issues pending I wonder why not concentrate on them instead.

    There are so many people from all EB categories whose I-140 has been pending for more than a year. Shouldn't that be a priority also because without an approved I-140 their GC will also not be approved even if they have a PD from 2001-2002.

    There are more important issues at hand here as I see it.

    What are u guys trying to acheive and how will this help EB3 India?
    This is awesome lead. It suggests that barring 203 (which does not talk much about per-country limits) and paragraph 2 (which goes moot when there is spill-over), there should be no discrimination. But does the anti-discrimination apply to "qualification requirements" ?? That will be the counter argument against applying this section.

    Folks, first of all don't try to slam me for posting this.. Here is a note that I got from my law firm Paul Hastings.. I am subscribed to their immigration related email.. I got this today.. While this has come as a shock to me, they are still preparing to file my I485.. I did not hear this from my lawyer personally, but only through this newsletter. I will speak to them about this first thing monday morning. Please read the note entirely.. Has anybody else heard about this..


    Update on Adjustment Filings for July

    Yesterday, we distributed a Client Alert reporting widespread concern as to the accuracy of the Department of State's (DOS) Visa Bulletin for July 2007 and indicating the possibility that United States Citizenship and Immigration Services (USCIS) may potentially not accept adjustment of status filings for all, or a part, of July. Today, multiple reliable sources have indicated that, as early as Monday or Tuesday of next week, the DOS could issue a revised Visa Bulletin for July 2007. Most likely, some or all of the employment-based immigrant visa categories would again retrogress and may become completely unavailable. The practical impact is that USCIS would almost certainly stop accepting adjustment applications for filing if the revised Visa Bulletin indicates that immigrant visa numbers are not available.

    This unexpected development would deviate from many years of agency practice. It would be devastating for companies and foreign national employees who have relied, as they are entitled to do, on the July Visa Bulletin and were anticipating the filing of adjustments throughout the month of July. We have initiated a concerted effort to aggressively address this unprecedented situation through the highest levels of the Department of Homeland Security (DHS) and the DOS. We are joined in this effort by many other organizations, and we are engaging congressional offices for assistance. Many have already agreed to speak with DHS and DOS. We will keep you updated.

    There are a few praises about Jet Airways in previous posts.

    Let me set the record straight. They have miles to go before they start claiming themselves as "world class" international airline.

    I was on vacation past 2.5 weeks to India and here is my experience.

    Regarding Jet Airways poor customer service:

    On return, my Jet Airways flight from Rajkot (Gujarat) to Mumbai was delayed by 2 hours. Its only a 55 minute flight from Rajkot to Mumbai. Because of this, my connection of Delta airlines from Mumbai to New York was missed. Delta gave me a seat on plane the next day. Same flight - but a day after. So now, I was stuck in Mumbai, with huge luggage for 24 hours. I asked Delta for Hotel accomodation. They said, its not their fault and its Jet Airways fault and I should ask them for Hotel.

    I went to Jet Airways customer service in Mumbai airport. They said that they cant find a single room in Mumbai due to some exhibition/conference going on at the time. A major international airline, shooting for stars, cant find a Hotel room in a city as big as Mumbai. Frustrated, I went to a government agency office (IATA I think) and they said that they dont have anything nearby, but can arrange something 30 kilometers away, and it was a sub-standard hotel and room. I paid out of my own pocket and stayed there a night. It was Rs 2000 (about $50) for this hotel plus taxi.

    The next day, before boarding Delta flight, I went to Jet Airways office again and told them that I found a hotel room on my own and see if they can re-imburse me for the hotel expenses. If they had paid themselves in Hyatt or Grand Meridian outside airport, it would have been more anyways. The manager of Jet Airways said that they cannot do it and I should scan the reciepts and my boarding pass and email customersupport at jetairways.

    An hour before this happened, the office didnt even have anyone in charge in office (at about 7:00 PM). The agent said, the manager isnt here. I asked, "who's in charge", and she said "No one is in charge right now, you have to come back at 8:00 when manager comes in".

    What I am saying is, Jet Airways has miles to go before it can take pride. Just starting flights to Newark, Chicago doesnt make it a great airline. Neither does good food. Treat customers well, and atleast do a better job than government offices when it comes to locating hotel rooms for stranded passengers who are stranded due to their fault.

    Mumbai Airport security harrassment :

    My flight was just past midnight and I checked out of hotel at noon. (I had to). With 12 hours and nothing to do, I headed to Mumbai airport. At the airport, they dont let you inside the building unless you are a passenger. The security guard at the door said that I need to come back at 9:00 PM and I cant go into the airport right now as my flight is at night. I told him that I am not coming to airport to enjoy the lounge and I am stranded due to missed airline connection. He didnt listen. I was sitting outside the building until about 8:00 PM with all luggage.

    Now I understand that security is important, but what's the point in stopping someone and letting them inside only 4 hours prior. Because if there is a nefarious person planning something bad, what can he/she do in 10 hours that he/she cant do in 4 hours. How does it enhance security by limiting the presence of passengers inside airport? Well, you cant argue with knuckleheads.

    Inside airport, I ran into a German lady and a guy from Netherlands and both of them were in the airport since the afternoon. They said they argued and they were let in. Basically, the Indian security forces at the airport wont argue with Europeans and will let them inside the airport but will go extra lengths to harrass people that they are comfortable harrassing - their own people.

    So we can ignore London airport. Fine. Are we also going to ignore Mumbai airport now?

    The best way to avoid harrassment is to stand up and fight it. Because avoiding this airport and that airline is not going to cut it.

    I had similar issues with Delhi airport security. I was supposed to take Aeroflot from Delhi and departure time was around 9:00 in the morning. Went to the airport around 6:30AM. Only passengers are allowed to enter the airport. The security guard looked at my ticket and let me in. I went through security check; wait in front of Aeroflot counter for hours. All in a sudden, Aeroflot said the flight has been delayed and departure time would be 7:00PM. They denied taking luggage or issuing boarding passes. I didn’t want to stay in the airport for that long. So took all my luggage with me, left the airport, got a taxi and went to a hotel.

    Checked-out of the hotel, came back to the airport around 4:15PM. The security guard wanted to see my ticket before he would let me in. He looked at it and said your flight is delayed till 11:45PM. Come back 3 hours prior to 11:45PM. I saw white people getting inside the airport without being asked any questions. I politely told him I would want to check with Aeroflot myself but he wouldn’t let me in. He told me with a very rude tone to call Aeroflot from outside phone. I also told him that I had to leave the airport in the morning once with all my heavy luggage and I will really appreciate if he could kindly let me in so that I wouldn’t have basically stand on the street with all those luggage. He was very hostile and didn’t let me in!

    It’s sad how these security guards abuse their power so much and treat South Asian looking people like trash.

    Just a couple of comments about Heathrow. The mainland of Britain was plagued with the IRA bombing it periodically for decades which forced them to be diligent about security long before the USA knew what terrorism was. Being security conscious has become a way of life on that little island in the North Sea. Just try finding a garbage can on a railway station platform? There are none so the IRA could not plant bombs in them.

    Now about the staff at Heathrow. Surely anyone with eyes that work can see most of them are not British at all but immigrants of some variety or another. A true Brit is a very friendly individual. The invasion of their island during the past fifty years has changed the face of the entire community, not all for the better that is for certain.

    And finally, transit visas etc. If they are needed and that is the rule and you cannot find a different route then it is something that has be lived with. The US had them and still has them for certain nationalities, the UK is certainly not on its own. I have been living in the US for almost a decade now and have been stung by their immigration rules as all of the contributors to this forum probably have but we chose to come here so have to put up with the system.

    We all have choices so if you do not want to get transit visas just choose a route that precludes the need for one. Ten pages bad mouthing the UK is not helping anyone it is just antagonizing those of us who originated there.

    Just because the majority of immigration voice are Indian it is certainly not all and I think that gets missed on so many occasions. We are in the midst of the US immigration system together, or so I thought.

    Every country has its own rules, some will be in our favor some will not but if we choose to go there we have to live by them. It is entirely NOT appropriate to expect countries we visit to bow to us on any level!!!!!!!



    i do not know why there is any bad mouthing of the English frankly...this has nothing to do with the people or even the city in question. my only visit to London was wonderful, i would happily visit again. i would though avoid transiting through Heathrow for reasons i explained. this is a govt policy- right or wrong and finding historical/colonial reasons is silly. it has a lot do with visa overstays as well, as was discussed earlier.

    just to clarify the issue itself though- and trying to keep it to the narrow focus- the direct airside transit visa is literally a run about created to check people that get off a plane at one gate and climb another plane at another gate- in some cases even the same plane! i do hope our british friends at least realise that it is a major pain to obtain visas to be able to do this- and it's not some kind of anti UK stand to avoid flying through LON (and other such airports) that enforce this. in the end it does create some bad feeling- i wish that were not true- but perceptions are fickle things. it's too bad though that everything seems to become about some wounded national pride or historical wrong or suchlike. wish we could all grow up :-)

    btw, since we have some engaged brits listening....is it worth the money to take the chunnel between paris and london? anyone done it? what's the best way to find cheap flights in europe? local insight would be much appreciated!!
    as you can see i'm looking forward to london again ;)

    I think it is the part of their process. I went an infopass the other morning and the IO gave me the same response. She said every thing was fine with my application. It was pre-adjudicated and now waiting for a review now that my priority date is current. She asked me to wait for 60-90 days. But I got the approval same afternoon :)

    Today I and my wife had an infopass appointment and were told that our I485 case is in Adjudication review and should expect an interview soon. I asked the officer is there anything wrong and he replied back that everything is fine. I am not sure what adjudication review is and why there is an interview if everything is fine :confused:

    We also opened SR on 9/1/2010 and I got the response today for the SR request and it has the following details

    "Your case is currently under review. You should receive a decision or notice of other action within 60 days of the date of this letter." Does this mean that we will not get the GC atleast in the next 60 days?

    Did anyone had an interview before or anyone know what should we expect in the interview.

    guys, i am now in UK and it's night time but trying to call as many as possible.

    also asked friends & family (in US) to start calling.

    can someone PLEASE start a email campaign (Yes, a chain letter) to at least the DESI community.

    This is a great chance for a BIG step forward and many of you have worked VERY hard (which has motivated me also, else i had lost hope).

    The calculation looks incorrect.

    You considered the I+ C allocations and subtracted those in line 1. You again subtracted those in your final calculation.

    The straight forward calculation is EB2 ROW is entitled to 34,436 (1) and they used 27,406 (2). So splillover was around 7 K.

    my lawyer's office just called me saying they would want to file ASAP, for which they want my signatures tomorrow. I met her an hour ago, when she was saying things like "hopefully by next week".

    So whether or not this is a rumour, it sure has clicked the panic button for lawyers too!

    If this is true, it is unimaginably bad. (Personally I still think it won't happen till end of July.)
