    There are a lot of interpretations. Popular Attorneys like Rajiv Khanna and Sheela Murthy claim it is not valid and always advise clients to have a h1b backup. Not sure why they are so keen on h1b. It could be because some adjudicators may send EAD revocations also along with 485 denials.

    Chandu, they may have other good reasons to do so, but one advantage for attorneys is an added fees out of filling for H1B; and for employers is less employee turnover due to the fact that even if employee is willing to change jobs. It is not so easy to find next job with H1 sponsorship than to be able to find one on EAD :)

    Raju Sen Sharma woke up Tuesday with one important errand in mind: He had to order flowers and have them delivered to Washington, D.C.

    The 29-year-old man, an Indian immigrant in Orlando, was not marking an anniversary or wooing a sweetheart. The flowers were for Emilio Gonzalez, head of U.S. Citizenship and Immigration Services.

    Sen Sharma was sending them as a symbolic reminder of the plight of foreigners like him, who entered the U.S. legally but cannot find a way to remain permanently.

    In a recent Indian-made movie, sending flowers to prove a point was the method used by the lead actor, following Mohandas K. Gandhi's teaching of nonviolence.

    So hundreds sent roses and daisies to peacefully protest the recent reversal of a decision that would have allowed many to apply for the "green cards" entitling them to permanent residency.

    Immigration-agency spokesman Dan Kane said about 200 flower arrangements had arrived at the Washington, D.C., offices by lunchtime Tuesday.

    Gonzalez said in a statement that he had those flowers forwarded "to our injured service members" at Walter Reed Army Medical Center and the National Naval Medical Center in Bethesda.

    "We have been trying to get the green cards in the legal way, and we have gone through all the process and it hasn't worked for us," said Sen Sharma, an energy-software analyst at the University of Central Florida. "We just want a fair chance."

    Other immigrants are joining a class-action lawsuit about the rejection of their petitions, to be filed by the D.C.-based American Immigration Law Foundation and the American Immigration Lawyers Association.

    Engineers, programmers, lab technicians and other educated immigrants had scrambled to file paperwork, following a June visa bulletin from the U.S. Department of State that gave them hope visas were still available.

    But U.S. Citizenship and Immigration Services issued a terse statement July 2, saying it would reject the status-adjustment applications because it ran out of those visas.

    Kane said he could not comment on the mix-up because of the expected lawsuit. The agency has an annual cap of about 140,000 employment-based visas; hundreds of thousands of foreigners compete for them.

    "It's very disheartening for people to get their hopes up and spend thousands of dollars in filing paperwork to then be told nothing is going to happen," said Aman Kapoor, president in Tallahassee of Immigration Voice, the group leading the flower campaign.

    Catherine Henin-Clark, an Orlando immigration attorney, said the cap leaves thousands of worthy immigrants in the limbo of temporary status.

    "When it comes to legal immigration, we are not encouraging the people that we want to have here," Henin-Clark said. "We are turning them away, and that is going to affect the economy one way or another. We have always relied on foreign workers."

    This is just a message to 2005/2006/2007 PD guys. Please don't think that some miracle will happen and dates will be current soon, it will take its own time. Mostly for EB2 & EB3June 2006- June 2007 guys, it will be like a lottery if the PD becomes current somewhere in 2007 Oct-Nov time. Right??
    So life is not always easy. There are people waiting since 2002-03-04.
    Don't think that life is not a FIFO always.

    Why some of the guys became violent when I said, INDIA IS GREAT???
    Guys.. do you know why I always feel like this???

    As my parents,in laws and most of my relatives stay there. Not only mine, allmost all guys who are in the IV, they must have parents and relatives in India for sure. There is no other reason why I said India is great.

    Someone asked me to pack up... YES, I will if nothing happens;however, I will be waiting to see the progress for sure. This is July. Let's have a look over OCT bulletin after 2 months and for sure dates will move atleast 4-6 months for EB2 guys and 1 year for EB3 guys. So wait, be patient, instead of doing all this.
    Anyway, our turn will come sooner or later, so why to become impatient just seeing the JULY bulletin CURRENT and then "U".

    Mainly this is the message for 2005-2006-2007 PD guys. Please don't take it otherwise.

    In the name of thinking differently we have smitha, senthil1 , asdqwe..and these guys confusing this struggle / fight for us trying to get ahead of the line or as senthil1 keeps saying uscis/dos made an honest mistake and asdqwe..keeps saying we need to fight for legislation rather than wasting time with these efforts. What all these guys and their ilk fail to understand is most of us are pissed off about the way it was implemented and handled rather than the ability to file AOS itself. If we sit and do nothing is like asking uscis / dos to walk all over us again and again. Besides in US law whenever there is a gray area, the decisions are based on precedents. This means if they have done this now means they can do this in any bulletin hence issued. They can issue a bulletin in Oct 2007 and on Nov 2 say "oops sorry my bad wrong bulletin" . Please come out of the basement and face the sun.

    My current situation is that my wife and I applied for 485 separately.
    my wife's PD is 2007 ( 485 applied in Aug 2007 )
    I applied for 485 in Oct 2007, Since my PD is 2003 and is current as of now ( my 140 is pending ), I talked with our companys lawyer on what options do I have with regards to my wife's 485.

    My lawyer suggested 2 options.

    1. File 485 again for my wife as a spouse derivative. As per lawyer, this is very common and has experienced with these kind of situations.

    2. Instead of filing a second 485 for my wife, just write a request letter to move her pending 485 to my 485 as a derivative. If this porting is successful, she cannot move back to her own 485.

    I know some of us have gone with option#(1), but since option(2) involves very less paper work, did any of you have used this option so far?

    I am confused as to which one to choose. My lawyer spelled diplomatic when asked about which option is better/safer:-)

    In principle, I agree with you that we are responsible for what we 'sign up' for and shouldn't back away from that. But, your example is a little bit off as in nobody is asking back money from the mortgage which is already paid (akin to the difference in gas prices that you mentioned), the interest rate could change and we are liable to pay the difference in the mortgage payments due that fluctuation - the thing here is the base value of your asset. As a hypothetical example (because vehicle prices always depreciate, so please ignore the reality), let's say you bought that Gas guzzling SUV at 50k and now suddenly after 2 years, due to whatever reason, you go and try to sell the same SUV to the same dealer and he quotes you 5k. Wouldn't you fault that dealer for selling you the same thing at 50k when the actual value of the same asset 2 year back was 5k (but he sold you at 50k and you have only paid back 10k in monthly installments until now). Who is to blame for that 35k deficit? You? Forget the monthly payments here and concentrate on the actual asset value.

    As mentioned above, I do agree that we are liable for what we do in life and one has to stand up for his/her deeds - but at the same time, and I again argue the same point, that the greedy people on wall st. and lending institutions are largely responsible for this mess - imagine if they had never sold you the asset for 50k, which is a bloated amount for that particular asset and the sad part in this is that the lender lends out the money knowing all this.

    Hmm interesting.

    So if I buy a gas guzzling SUV/Truck and the price of it goes down to 1/4 because of soaring oil prices, I guess dealer should pay me back the 3/4 because it is not my fault. Right ?
    And if I bought used Hybrid which is now selling like hot cakes and I make a profit I must redeem it to the car dealer. Because I made money I didn't anticipate. Also, my 401K losses should be returned back because it isn't my fault the stocks are loosing value. The price of gas I paid this summer was twice what I am paying now, so I must get back the money I spent this summer, because it is not my fault that there has been fluctuations in the oil prices.

    Well, if only it were that simple. That's not how the system works, although you would want to be that. When you sign the dotted line you are in the binding contract and from then on profits, losses and fire sale is all yours.
    You have to live up to what you have signed or next time around you signature will not be honored.

    read their terms and conditions...the unlimited plan holds good for normal residential use.Normal residential use is defined as a usage of less than 5000 minutes.so basically it is a hidden way of saying 5000 min/month.if it goes over that vonage can disconnect your service or charge extra per their discreetion

    Let it be 5000 min/pm. Still, 5000 min/month give about 2.7 hours per day. Talking 2.7 hours to India per 24 hours is unusual for many. I don't even get 30 minutes to talk. Even if we want to talk 2.7 hours you will be distrbing people in India, as they may be watching cricket or Tv serials.:)

    Any way, this pan is simply superb compare to the situation before 10 years. Compare to many phone providers/cable compaines, vonage customer service is simply great, at least in my experience.

    I have a few theories on this. This is meant just to open discussion.

    1) The USCIS and State department are not communicating at all. This is not at all uncommon within gov't agencies as we all know.
    The State Dep't released the bulletin perhaps without realising the full ramifications. Having heard from the USCIS..........hey hey hey what the F&^% are you doing? They may have realised over the last few weeks what a mess they have on their hands. Now they are trying to undo it.

    2) Another possibility I can think of, is that this is a grand plan(heck I almost said grand bargain) concocted by the USCIS to get 485s OUT of the system as much as possible while minimising those that can get IN. Hence you might see in the coming few weeks thousands of approval letters all dated the 2nd of July. That will allow them to clear their backlogs of pre-approved, approvable cases and clean the slate fresh for the new fees structure/new quota in the new year. Some of you might remember they retrogressed to unavailable around this time 2 yrs ago. They do these weird things in the 4th quarter.

    3) Of course the last option is their brains have the same IQ as that of any common critter that messes up your garden.

    Pick your poison, it is all the same. I feel for everyone whose hopes were raised so high. It is truly inhumane of them. If they planned this, they should atleast have delayed the release of the July VB.

    Dude, then why are we blaming people like punjabi.........it is not his fault that the supply was abundant and demand receded..........I would still blame the banking system for the housing failure.......they landed out money which they knew would stop coming back at one point in time........and again, it's not that he cannot afford his monthly payments...........he just cannot sell his asset - to me that is a problem on the part of the lender and not the borrower. No wonder banks are re-adjusting the home loan amounts (to a much lower value than originally specified in the agreement) for people who cannot pay the normal mortgage (due to whatever reasons). Go and teach the same lesson to these greedy banks and lending institutions.

    Again, I am not saying that foreclsosing (escapism) is a good route to take, as there are other ways to keep the paying the mortgage without hurting your mobility but at the same time it is not prudent to blame it entirely on the borrower - lending institutions are responsible for major part of this mess.



    gO learn the concept of supply and demand before asking a question as to why banks are lowering their appraisals!

    I am not into conspiracy theories, but this one sounds like one, i.e. Mr. Oppenhemer (not sure about the spelling), announced major advances to the EB 2 I queue in the last week of March, now did he know the government was shutting down ?, possibly, well if the Govt shuts down, all visa offices/ Passport / Immigration offices shutdown, so let us say if the dates do advance considerably, and voila the Govt shuts down, well most of the folks will be current but unable to file for change in status due to shutdown, and when the Govt comes back up so will the visa numbers retrogress. I hope I am totally wrong, but you never know.
