Lou Dobs is going to talk about immigration legislation burried in defence spending bill (which is under debate now) now. He just mentioned that there are pieces of 'Amnesty' legislation in the bill and he is gonna talk about it.

What I am suggesting is that the right time to take this up is when a recession is not in full swing. Between 2004 (when this law was enacted) and 2007 was a great time to pick this battle. Maybe another year down the line would also be a great time to pick it. Picking up this particular battle right now would probably make YOUR and MY lives much more difficult in the medium term.

He cant increase the budget in the current environment. So he probably will hire a couple of GC holders/Citizens and replaces the whole division (with 50 GC/Citizens besides the 50 'violators') with an offshore team.

U are saying - The person's GC category should be same all through out the GC process, irrespective of the technical advancements the person make during the course of the GC process. A person is porting only because he is qualified for the category, U folks are talking as if there is an open slot and everyone is clamoring for it.
U'r logic should be similar to the below scenario..
A person joins a company as a Jr. Engineer, then based on U'r logic he/she cannot become a Manager (which requires an MBA / equivalent) because he entered the workforce as a Jr. Engg. Even though the fellow would've acquired necessary skills and even MBA (going part-time to school), still he/she cannot become a Manager. U are vouching that an MBA who joined few months earlier can become the Manager but not the home groomed fellow. Wow, U'r logic seems to a ground breaking thought process, please extrapolate U'r lawsuit for the case mentioned above. If you win, this might be the most ground breaking decision in US.
Personally I've reported to folks who joined company as high-school grads and worked their way up to Managerial position ofcoz acquiring the necessary college education while working. They have shown up those experience to move ahead of other folks who joined later with higher degrees.

JE goes on H1B (as Junior Engineer) while MBA goes for an MBA on F1.
In 2003, JEs company files for his GC, PD 2003, EB3
In 2004, MBA graduates and joins a company as a manager.
In 2005, MBA's company applies for his GC in EB2, PD 2005.
So far so good.
Now, it is 2008. Both are still waiting for their GC.
Ideally, both are in same position (they should be, as both have same amount of exposure to professional world after undergrad - one replaced the work experience by higher degree and vice-versa).
Now, JE wants to port his PD and get into EB2 category with PD 2003. This will make him exactly 2 years ahead of MBA. If he doesn't port, they are approximately in the same situation, so the chances of them getting a GC in 2009 will be same.
What do you think is fair?

Even if you are on a 24.99, you will have to call up the customer service (or go online) to change your plan to something called a "World plan" (which is also 24.99), then you will not see any charges for international calls.

Damn this sucking life man, no social life, no career life, no nothing life. Even animals must be living a better and meaningful life. It sucks big time, did it ever happen in history that uscis revised a visa bulletin on the day it is supposed to go into effect ....

It is a good thing that HR is talking to their legal dept. Legal should state that EAD status is not valid grounds of refusing employment. Consulting with their legal department is actually a good thing, have faith!
ok this is what I have
a) email with offer of employment and link to I9 form in offer letter
b) accepted verbally
c) background check done and report sent to me
d) called and was chatting when I mentioned EAD, was told sorry we cant offer you employment due to EAD, and that is has to EAD filed by this company only because they cant verify its legality et., one way was for them to do my h1b but they are not hiring h1b right now, so sorry. later they said they would consult with legal and get back to me. however i dont hold out much hope
e) i immediately filled out the i9 form
f) wrote email to them outlining our conversation from d) explaining my surprise (and boy! was a surprised!) and trying to make my case that I was not a risky bet for the company because of how interminably long I have been in this country and my spouse had GC already, but mine was not processed in time before priority date became not current.
g) hr wrote back, acknowledging our conversation and saying that they were not sure and that is why they were going to consult with their legal dept and will talk next week.
All I have are emails and offer letter.
I really dont want to go the legal complaining route if this can be resolved. But I am in a fighting mode. I probably would not have been so upset if I had not turned down other interviews...

I came across a couple who got their H1B approvals last yr with in 3 weeks to each other. One of them was in PIMS and other one not. So I feel approval date does not seem to be a criteria to base these delays upon.:confused:

Vonage's cancellation early termination charge is $39.99 + Some admin charges = $45.
The $100 you are talking about is when you sign up and also ask for the router from vonage. what I did was went to craigslist and bought the vonage router for $15 and signed up for vonage. They sent the cancellation policy and charges by email which is somewhere between $40-$45.
I was earlier their customer when moved from vonage to T-mobile @Home. After a little argument they waived off the early termination charges and now because of the good customer service I joined them back. As by joining I got a free month of phone service as well.
I would say the reps on the other side also human being and depends on how one goes on to put up their point in the most polite manner without hurting anyone or anything in the process and results are always fruitful if the conversations are driven the right way.
Overall for me to make calls and recieve calls without any hassle is the key and I think vonage is pretty good at it. Moreover they moved their customer care I think moved back in US from phillipines as this time the conversation was smooth and didn't have to repeat the sentence again or didn't have to ask to say again.
Also I don't care if any competitor comes up with a $2 less + some more feature. Quality is the key and I think vonage beats everyone in that. I had a tough time fixing up my fax machine wiht sun rocket once upon a time and cancelled my service with them for that reason.
Vonage has a contract of 1 year. Have to pay around $100 if you break the contract.
Lingo has a contract for 2 years. Will have to pay a similar contract break fee for Lingo as well.

I called Vonage Customer service , If you signup Vonage World there is no 5k Min. limit. Its unlimited. Guys please don't post the wrong info.

only 4000 EB1 pending; even if all of them are approved, and with 1000 more in 2010, we have 30,000 EB1 rolling over to EB2. ROW EB2 quota ~ 25,000. pending eb2 row = 7150. even if we have 15,000 more approved in 2010, eb2 row consumes 22,000 and the remaining supply = 33,000 which can go to china, india, mexico and philippines.

hi,
My lawyer filed for my EAD in April 2005. I have been working on H1 all the time and i was not aware that he filed for my EAD.
HE filed for my AP at the same time and i got it. When i asked him about EAD , he said its not required and that he did not file it.
Yesterday he mailed me a set of copies in which i found receipt notice for EAD.I checked the status and it says that my case is pending since April 2005.
There was no request for any proof or anything. It just says we mailed you notice of action and the case is pending.
I need EAD now. What should i do?
I called the USCIS and they said that it is out of processing time and filed a service request.
All my friends who filed their I-485 recently got their Biometrics notice and i didn't get any. Whats wrong with my case?

There was no request for any proof or anything. It just says we mailed you notice of action and the case is pending.
I need EAD now. What should i do?
I called the USCIS and they said that it is out of processing time and filed a service request.
All my friends who filed their I-485 recently got their Biometrics notice and i didn't get any. Whats wrong with my case?
I am confused , what am i supposed to do?

Everyone makes a mistake. That does not mean they would not have any after effects. They will.
Congress have a bigger issue on their plate right now. That is Iraq. I am pretty sure Congress would take up this issue in near future. Make your voice heard to Congress. Then pray to God/Almighty.
We have congress "helping us out" by doing WHAT exactly?? So far we have exactly ONE congresswoman who made a statement. After that no one has even BOTHERED to do anything.

Saimrathi, you are posting the same message on all threads. Anyway, I am sure some of the media will pick up the story and write about it. I think there are benefits from this campaign. The name Immigration Voice is out there. We may get more members of our community to join us and participate in future campaigns and we can learn from experience on how to carry out future campaigns, protests etc. We had to speak out in some way on what happened to us with the USCIS Visa Bulletin fiasco. I believe it was worth it for all these reasons.

He/She posts the same thing across three threads and whats the point of the boxes being opened by Mr Gonzalez or being received by him intact. You must be trying to play spoil sport here or just acting childish. Can you send me a PM with your number and I would like to talk with you and help you understand what we were trying to accomplish here?

The priority dates became current right before the immigration bill was to be brought up for the second time in the senate. Now as the bill has been shot down, next day these rumours begin surfacing. Guess no need to keep us distracted anymore, so no need to go through the pain of getting bombarded with applications.
I feel, both are extraordinarily extreme measures. Make priority dates jump 5 years in one month and then retrogress them in the middle of the month.
