It was on Dec 2005 . Luftansa . Chennai - Frankfurt- Dallas . I was waiting for my boarding pass . I handed over my e ticket to the lady at the counter. Instead of issuing the boarding pass , she asked me about my H1B papers. I got confused . Why should I show my papers to this lady ? . Since it was my very first trip to US , I meekly showed her my papers.After that she had issued the boarding pass.
Friends, you may think I am very meek.This was not my first overseas trip. I had visited Japan previously. I didn't want to have fight with her and start my journey in bitter taste from the beginning.
Don't think only Non-Indians treat Indians shabbily. Our enemy is within.
If I happened to see that lady once again in Chennai -------

Raju Sen Sharma woke up Tuesday with one important errand in mind: He had to order flowers and have them delivered to Washington, D.C.
The 29-year-old man, an Indian immigrant in Orlando, was not marking an anniversary or wooing a sweetheart. The flowers were for Emilio Gonzalez, head of U.S. Citizenship and Immigration Services.
Sen Sharma was sending them as a symbolic reminder of the plight of foreigners like him, who entered the U.S. legally but cannot find a way to remain permanently.
In a recent Indian-made movie, sending flowers to prove a point was the method used by the lead actor, following Mohandas K. Gandhi's teaching of nonviolence.
So hundreds sent roses and daisies to peacefully protest the recent reversal of a decision that would have allowed many to apply for the "green cards" entitling them to permanent residency.
Immigration-agency spokesman Dan Kane said about 200 flower arrangements had arrived at the Washington, D.C., offices by lunchtime Tuesday.
Gonzalez said in a statement that he had those flowers forwarded "to our injured service members" at Walter Reed Army Medical Center and the National Naval Medical Center in Bethesda.
"We have been trying to get the green cards in the legal way, and we have gone through all the process and it hasn't worked for us," said Sen Sharma, an energy-software analyst at the University of Central Florida. "We just want a fair chance."
Other immigrants are joining a class-action lawsuit about the rejection of their petitions, to be filed by the D.C.-based American Immigration Law Foundation and the American Immigration Lawyers Association.
Engineers, programmers, lab technicians and other educated immigrants had scrambled to file paperwork, following a June visa bulletin from the U.S. Department of State that gave them hope visas were still available.
But U.S. Citizenship and Immigration Services issued a terse statement July 2, saying it would reject the status-adjustment applications because it ran out of those visas.
Kane said he could not comment on the mix-up because of the expected lawsuit. The agency has an annual cap of about 140,000 employment-based visas; hundreds of thousands of foreigners compete for them.
"It's very disheartening for people to get their hopes up and spend thousands of dollars in filing paperwork to then be told nothing is going to happen," said Aman Kapoor, president in Tallahassee of Immigration Voice, the group leading the flower campaign.
Catherine Henin-Clark, an Orlando immigration attorney, said the cap leaves thousands of worthy immigrants in the limbo of temporary status.
"When it comes to legal immigration, we are not encouraging the people that we want to have here," Henin-Clark said. "We are turning them away, and that is going to affect the economy one way or another. We have always relied on foreign workers."

The United States benefits from our ability to attract and retain needed immigrant and non-immigrant students and workers, and it is important that America remains competitive in attracting talented foreign nationals."
You can advance your stated objective by making common-sense administrative reforms to fix a system that is clearly broken. Implementing much-needed reforms will also free government resources to focus on pressing national security matters. For example, current rules require the Department of Homeland Security to renew the Employment Authorization Documents (EADs) of hundreds of thousands of legal immigrants each year as those immigrants wait for green cards and permanent residency in the U.S. Rather than renew these EADs annually, the government could renew these documents every three years, freeing countless hours that could be better spent serving the Department's mission.
The greatest impact of the broken green card process is borne by the legal immigrants and their families. There are more than half million highly-skilled legal immigrants already working productively in the United States who find themselves trapped in a system that is taking years longer than intended. During this wait for a green card, these immigrants remain trapped in a legal maze, unable to change jobs - even within the same employer - without starting the arduous immigration process over again, and subject to waits that grow longer and longer.
We implore you to exercise your authority to implement administratively these much-needed reforms.
Recapture administratively the unused visas for permanent residency to fulfill the congressional mandate of 140,000 green cards per year.
Revise the administrative definition of "same or similar" to allow slight additional job flexibility for legal immigrants awaiting adjudication of adjustment of status (I-485) petitions.
Allow filing of Adjustment of Status (Form I-485) when a visa number is not available.
Implement the existing interim rule to allow issuance of multi-year Employment Authorization Documents (EAD) and Advance Parole.
Allow visa revalidation in the United States.
Reinstate premium processing of Immigrant Petitions.
I earnestly urge you to implement these administrative remedies without delay, otherwise many immigrant families who came to USA legally to become a part of the “American Dream”, will continue to stay in a limbo. Just an idea !
Please stress about how you cannot buy a house because your immigrant status is always in limbo and you have plans to buy house as soon as you receive greencard.
Look at the market today. It tanked another 250 points. Give greencards, alleviate mortgage crisis to an extent.

that is actually true. My heart goes out to the people who were stuck at a date for an year and a half, and all of a sudden that date jumped two years...
I asked my lawyer this, and he said that per a USCIS (Pearson?) memo you can change the underlying I140, but it applies to the same person. This is called interfiling. He said some people have taken this to assume that you can also request that underlying I-140 be changed across applicants, and primary-derivative names be flipped, but he is not sure if this will work, he has never done this in any case so far, and its a grey area.

It's funny how many types of personalities you see in everyday life. I remember in my early childhood days there always use to be one guy at the least in my class who would do things that would freak everybody out....usually he would be the teacher's cutest student. But once the teacher was out.....maan his ass was all red in the hostel, in the class.....just kept running away from every other fellow student.....

8) Family photo with Mother, Father, spouse, kids , siblings. While background, taken less than 6 months ago. Frontal view :)
Avoid them at all costs....

I am not saying that we are reporting fraud just for the sake of not tolerating it. This is effecting our GC. Earlier the effect was related to the job being taken away now it is effecting our GC too.
Initially L1s were sponsored only by large offshore companies like TCS, WIPRO etc.. The effect was that the jobs were taken away. But it did not have much effect on the GC side as most of these large offshore companies do not process GC for their employees.
But nowadays lots of small Offshore companies started doing L1As. These companies do not have lots of clients like TCS or WIPRo but they have a handfull of clients. So to make sure they have their clients they started bringing people in L1As and processing GC under EB1 for them. Although many of these people are developers and should be in EB3 and should be behind in the line. But as they are in L1A and are appling in Eb1 they are getting GC in no time and also taking the visa#s away. There are hunderes of these small offshore companies started getting people in L1As. Thus these EB1 Visa #s are not overflowing to EB2. This is effecting our GC.
Now we have :
1. Large offshore companies sponsored L1s taking the jobs
2. The small offshore companies sponsored L1s taking the GC visa #s.
If the L1As are indeed senior Manager then no problem, but the Developers/Business Analyst/ Project Manager without hire-fire authority are getting GC under EB1.
Thus these frauds should be reported so that at least the # of EB1 visas are not taken by fraud.
So you too can see how this fraud is effecting us all.

EB1 visa never belonged to EB2 or EB3 category. What if there were enough genuine EB1 people to claim all the EB1 visas. There won't be any spillovers. Spillovers are bonuses. It is never our right to claim those.

EB1 visa never belonged to EB2 or EB3 category. What if there were enough genuine EB1 people to claim all the EB1 visas. There won't be any spillovers. Spillovers are bonuses. It is never our right to claim those.

The point was about abusing the system to get ahead in the line. In that way labor sub shares similarity with PD porting. If a person who landed yesterday fits the job profile and the law allowed it , then what's wrong.
On the other hand if those labor are sold for a price then it is serious problem. And thats why Lab Sub was eleminated. Now thats what is going to happen (and happening) in PD porting case.
any action should be against the so called "paid PD porting" cases. But why harm a honest EB3 person switching companies to go up the ladder? If he is getting the benefit of the rule, what is wrong? As long he it is done by the law, I do not see any problem.
Tomorrow, if you get a position that justifies EB1 category for you, would you not move to that category? Nothing wrong in that either.
I endorse Pappu's comments. Wrong doers can be punished. But people benefiting by a certain rule should not be.

I have got email from my lawyer too regarding the change in bulletin coming MONDAY. I am worried for my life again. Is this all worth it? Title of her mail is I-485 could be rejected in July. I am done with this damn life. I can't take it anymore.
I really feel like crying now. Sitting on h-4 for 4 years and now I see a ray of hope and that is squashed too. I don't think this is fair. This is just not fair. Why the hell in the first place they have to make it current? I feel bad for all of us.
How many hours, how much money, how much effort, feelings, aspirations, hope. so much was built on that one news and the days from then on. and today it is NOTHING. I am sick and tired of this life.
Who is there to listen to us? NOBODY. Who will straighten this mess for us? NOBODY. We support each other and today we again have just one another to fall through this.

What is the least effort that you can put towards your immigration?
If you cannot write or type a letter, i'm afraid you don't belong to the "Hard working, highly skilled" immigrants that is being referred to in the letter.

Just my 2 cents... Don't think USA is like India where you can do something forcefully. Why don't you guys understand the real problem of USCIS.
Do you think that by sending flower to USCIS will force them to make EB2/EB3 current for 2005/2006/2007 guys??
Please try to understand their problem.
Also India is the great. Why don't you guys just think that India is your home country where you are born and brought up. Why you people can't just wait and watch?? If nothing happens to the so called GC, then why don't you think to pack up and go back to India???????
My sincere request, please don't do rally, you might be arrested......you never know what they can do..... Don't you think that, it is better to go back to India rather than being embarrassed here in US???

Called one more time using the POJ method to NSC... This was probably the most fruitful call to NSC in the last 7-8 odd times i have called them.
Someone called Terry answered the call... Hats off to this lady...If there is a way i would want to recommend this lady for a promotion and make her the project manager for all the rest of the IOs who answer the call!!!
My case PD is 1/15/05, filed at TSC, transferred to NSC in Mar 08, applied AC 21 in Aug 08 and did biometrics in Feb 09.
Information i received on my case from this call:
1. This lady got my receipt#, checked details and history on my case, let me know that the case is preadjudicated (she defined preadjudication before that)
2. and then, told me that the case is NOT in storage area.
3. She mentioned that preadjudicated cases are held in an area called exams area and my case is currently on its way from exams area back to the officer who had preadjudicated my case earlier in Oct 2008.
4. She then checked my wife's file to see if that is also with my case just to make sure that file is not lost etc and confirmed that both files are together.
5. She also mentioned that nothing else needs to be done right now for my case as it is already on its way back to IO.
Thanks to know that there is atleast one person at NSC who understands what we are going thru' and is willing to atleast provide some details...
