Leave the late night comedians out of it.
Who do you think they will poke fun at? USCIS, Emilio Gonzalez or the people spending thousands of dollars on flowers that wont even reach the office of the intended recipient?

Actually, I'd say (especially for Stewart and Colbert) that they'd be poking fun at the right people

Can anybody tell me what do i need to put on I-765 , Q11, as i am not able to rely on my company's attorney.

11.Have you ever applied for employment authorization from USCIS?

As per the following link - http://www.uga.edu/oie/ISSIS/form/Department/PR/Instructions%20for%20I-765.pdf

it says that you need to put yes and have to attach all the previous 797's.

But my attorney says that you need to put No. Only those who applied for EAD earlier have to put yes (Which i feel not correct).

    can anybody clarify please.

    Thanks in Advance.

    =====================
    contribution so far 100$

If you have never applied for an EAD card before then the answer is NO. If you have had an EAD before then the answer is YES. Pretty straightforward really. Your work visa is not an employment authorization in this context.

May be I am wrong. I want to be wrong since I would like to File for I 485 , but this is from DOS site, can you share your source ?

Hi GC ON DEMAND, I think you are right... Looks like we did not receive any spill over from EB1 and EB2 ROW --- Here are the calcs...

Regular EB2 ROW gets 34,436 -- see below for break down

We know that EB2 gets 140,000 * 28.6% of visas which is 40,040.
Out of 40,040, 7% is allocated to china and an other 7% goes to India.
    So EB2 ROW = 40,040 - 2*(40,040*7%) = 34,436 -------------------------------------------- (1)

In the document that you have, EB2 ROW received 27, 406 visas... How? see below

    Total allocation for Eb2 (A1) - 53,872
    India received (B1) - 19,961
    China's received (C1) - 6,505
    -------------------------------------------------
    EB2 (ROW) net = A1-(B1+C1) = 27,406 -------------------------------------------------------- (2)
    --------------------------------------------------

    EB2 (I&C) Regular quota {2*(40,040*7%)} = 5,604 -------------------------------------------(3)

    (1) - (2) - (3) gives the spill over from EB2 ROW to EB2 (I&C), which is 1,426

Which means EB2 ROW to EB2 I&C spill over is mere 1,426 ???? Hope we are wrong... this looks scary...

Look at the breaking news section here : http://www.immigration-law.com/

it says may be only 1/2 of them are receipted.

If any dept can just publish, how many cases are still pending for receipt & how many receipts are issued per day/week, it will give us an idea on how long we should WAIT....YES I KNOW THAT IT IS TOO MUCH TO ASK FOR....WITH THE WAY THINGS ARE GOING WITH THIS AGENCY.......

I HAVE STARTED CALLING USCIS TWICE EVERDAY NOW....MAN THIS IS REALLY FRUSTRATING!

I want to move from reliance to airtel or trueroots before deciding on vonage. Can someone tell me as how good is airtel 1c/min offer? hows the quality to india and other countries?

    Thanks

Airtel call quality is really good and it's cheap compare to reliance....I stopped using reliance almost 3 years......if you pay 9.99+taxes will give you 600 minutes talk time and 45 days validity...I also used for australia and singapore, call quality was great...never had any problems...

What Pappu says is right. Ppl have been so impatient that they're bombarding USCIS with SRs, emails, letters from attorneys, Infopass etc..etc...etc...I understand the anxiety but isnt this a bit 2 much? I was no exception to this. I raised an SR on the very first day my date got current and on trying to followup on the SR the very next week, I stumbled upon a clearly tired second level IO who didn't like the way I was pushing for it. He clearly explained to me that there was no need to worry as the dates were current and everyone who was current and cleared of security would be approved as there were several visa numbers available and he also told me that there have been thousands of calls received everyday and its becoming really hard for them to handle the situation. I could see how tired and frustrated he was. I immediately understood their plight and just waited without any further action and within a span of 15 days after that call, I got my approval. My attorney also advised me to wait as he was sure the dates were gonna be current the next month as well and followups would only result in delays.

Well I'm not saying its wrong to be anxious. Ofcourse, its an important milestone, one that secures our future in this country and yes, its only natural to be anxious. But being anxious doesn't mean that by calling or emailing or Ombudsman etc...ur case will be approved. Try and put yourselves in the IO's shoes as well. For a moment think what it wud be like to be an USCIS first lvl/second lvl IO receiving the same call every minute from a diff person and each one trying to reach the second lvl IO with lies such as my A# on file is diff than the one on 140 OR address change etc...etc...This is ridiculous. After years of wait we resort to such shameful behavior towards the end.

Yes when others with later PDs are getting approved and u r still waiting, it does bring out frustration in u. But u should also put in thought as to why that could be. Maybe one of the security checks in ur case is awaited or maybe ur file is on some table waiting to be picked up etc...I was venting out my anger and frustration during my wait on this forum and ppl were only asking me to do that, do this blah blah blah. I just waited nevertheless as I knew the moment I spoke with the IO that there was really no point in following up as cases were getting approved and USCIS was definitely WORKING as hard as they could (even on weekends) to clear all current cases.

There was one dumb idiot who called and spoke to the second level IO (per his own words "just to confirm") even after getting the CPO email. I mean how foolish and idiotic is that. Check this out...I'm not kidding:http://immigrationvoice.org/forum/forum5-all-other-green-card-issues/1600323-conflicting-info-cpo-email-but-485-pending.html

Guys, just trust USCIS now that they've been approving left and right before u login to ur email to followup or pick up ur phone to check ur status. EB2 has not moved ahead for the Oct bulletin but ppl who were current from July will still be current in Oct. What does that mean??? It simply means that USCIS is hell bent on clearing all the cases which have been current since July and my best guess is until the last of the "current" cases has been approved, the dates will be not be retrogressed.

i understand everybit you explained here but your missing human anxiousness whether it is GC or OC(no meaning) people willnot stop doing enquiry i think you might did to and being hypocritic that everyone is anxious about doing so the explaination looks like your working in uscis customer care and taking care of all this everyone knows that uscis doesnot only deals GC and not only we are calling them
    take it easy brother

Plaintiff suggests that the fact that her application
has been pending for nearly three years is patently
unreasonable. She argues that Congress intended
applications to be adjudicated within 180 days. See 8
U.S.C. 1571(b) ("It is the sense of Congress that the
processing of an immigration benefit application should
be completed not later than 180 days after the initial
    filing of the application . . .."). That [*10] 180-day
timetable may provide some guidance here, although the
"sense of Congress" expressed in INA Section 1571(b)
does not necessarily carry the force of law. See Yang v.
    California Dep't of Social Servs., 183 F.3d 953, 958-59
    (9th Cir. 1999).
Defendants argue that there is no statutory deadline
by which applications must be adjudicated and that, in
any event, the "first-in, first-out" protocol must be given
deference. True, Congress has not established a
mandatory timeframe for the USCIS to adjudicate
applications. Moreover, "'[t]he passage of time alone is
rarely enough to justify a court's intervention in the
    administrative process, especially since administrative
efficiency is not a subject particularly suited to judicial
    evaluation.'" Yu, 36 F. Supp.2d at 934 (quoting Singh v.
    Ilchert, 784 F. Supp. 759, 764-65 (N.D. Cal. 1992)).
However, the court also recognizes that there is no
precise formula for determining whether there has been
an unreasonable delay. Instead, "[w]hat constitutes an
unreasonable delay in the context of immigration
applications depends to a great extent on the facts of the
    particular case." Id.

I can't believe this is happening to me. My priority date became current as of June1. My attorney has sent my wife's petition to Chicago instead of NSC. He got the petition returned this afternoon. I got my I485 approved on June 25. My wife is currently out of status. If the rumor is true, I'll be totally screwed. After 10 years in this country, a dumb mistake pretty much ruined my life.

Why did your attorney send the package to Chicago instead of NSC??
    Who is your attorney??

I too had similar thoughts.. why would CIS/DOS stop keeping buffers? Is there any particular reason? Once they complete all 7/2007 applications I think it makes sense to move the date for a few months so they can accept applications. Also, remember there will be new monthly quota getting allocated to all categories. So to use those numbers should they not be progressing dates?

    Rodnyb,

The below number is depressing, however dont you think DOS/USCIS always believe in keeping buffer and they may push the dates somewhere into 2009 just to accept 485 filings?

Why do think they will stop keeping any buffer?

[QUOTE=rodnyb;2494192]Teddy, I agree some of your data. Mine would be (90% confidence level)

    Guys,

I have heard from friends that if after 90 days of applying you don't receive an EAD card, you can walk into a local USCIS office and they will issue you an EAD. Is this still true? If yes, what documentation do I need to take with me? Its been 2 months since I applied. Anybody know how long it is taking from NSC?

    Thanks

All DECT 6.0 phone have 1.9 GHz signal.
    No 6. Ghz phones available.

    SEE DETAILS BELOW FROM WIKI

    DECT 6.0
DECT devices made for use in the U.S. and Canada use the term DECT 6.0 to distinguish them from both DECT devices used elsewhere and U.S. cordless equipment operating in the 900 MHz, 2.4 GHz and 5.8 GHz ISM bands. It is a marketing term coined by Rick Krupka, Director of Cordless Products at Siemens, when he was pushing the FCC to accept DECT in the US and is not a spectrum band reference. The term "6.0 GHz" for DECT 6.0 phones is incorrect as they operate at 1.9 GHz, but the term DECT 1.9 might have confused customers, as they may solely interpret larger numbers as signifying a better (or later) product.

I am using DECT phone. It is mentioned as DECT 6.0

is it same as 1.9GHz or different 6.0 GHz?

Every 485 applicant needs to submit birth certificate. If in regional language then get it translated in english. I dont know any place/person for translation, but you would need to submit english version.

Do we need the Birth Certificate for secondary applicants(spouse).
None of the checklist(Employer based I-485) I have been thru say that I need the secondary applicants Birth certificate.
My spouses Birth certificate is in a regional language, and hence the question.

Moved this to the Birth Certificate thread.....
