AMY GOODMAN: Another guest that youve had on the shownow, this is a very important point, and this is one that you would agree that youve covered, and that is Arizonathis is very importantthe Protect Arizona Now referendum. In late 2004, it was revealed that the new head of the national advisory board to Protect Arizona Now, an anti-immigration organization, was a longtime white supremacist who was also an editorial advisor to the racist Council of Conservative Citizens. Although Virginia Abernethys controversial selection was reported prominently in virtually every Arizona paper, and despite the fact that Lou Dobbs heavily cover the anti-immigration referendum that Protect Arizona Now was advocating, you never mentioned the affair at all, her controversial selection as head of this group.
LOU DOBBS: And she was featured in how many reports?
AMY GOODMAN: The point is, you covered Protect Arizona Now extensively, and this is certainly significant, when it turns out that the head of the board of Protect Arizona Now is
LOU DOBBS: And when was the last time she was on the show?
AMY GOODMAN: No, the important point is, you didnt report the news of this very controversial
LOU DOBBS: Is it possible
AMY GOODMAN: racist woman who headed Protect Arizona Now, which was virtually in every Arizona paper. The question is
LOU DOBBS: Concurrent with our reporting?
AMY GOODMAN: what you report and what you dont.
LOU DOBBS: Concurrent with our reporting?
AMY GOODMAN: Of course. This is in 2004. The point is, what you report, Lou, and what you dont report.
LOU DOBBS: Well, you know, Amy, I dont know what to tell you, because, you know, based on your focus here today, you have focused on probably three or four reports, as best I can figure, out of more than five years of reporting on the issue. If that smacks at all to you of reasonable proportionate journalism on your part, I mean, God bless you. If thats what you believe, God bless you. But I think youre coming from an ideological position that has just absolutely skewed that perception and that perspective.
AMY GOODMAN: I admit my ideological position, which is that I think that the Council of Conservative Citizens is a racist group, and its problematic
LOU DOBBS: OK. And I think that you are a wonderful, pure and absolute infallible human being.
AMY GOODMAN: not to identify guests that you have on your show that are connected with this group.
LOU DOBBS: Unfortunately, I am a fallible, and I am a man who has made some mistakes. But the reality is, the body of work stands for itself, and you know that. And the reality is, the facts are irresistible. Illegal immigration into this country is absolutely not in the American interest. And that is a reality youre going to have to contend with.
JUAN GONZALEZ: Lou, no, that fact is not clear. You know, first of all
LOU DOBBS: Not to you.

Guys,
I got a letter from Cong Tom Price (Rep- GA) saying that the immigration clauses in the Budget Reconciliation Bill did not make it. But he will try to push for those clauses in the immigration bills in 2006.
I got the same message from his DC staff, when I called to follow-up.

Please check with some other attorney too. As per my understanding, you can not file H1 from your own company.
I don't have H1 backup and already in 8th year. I am on self employment, But my lawyer suggested to apply H1extension (through my company) as a backup if MTR denied. If MTR are successful they I don't have to go on through H1 hassle again..

Thanks much for providing this info..i will be contacting my local congressmen..I need small help..where can i find my A#?
USCIS declares in weekly updates that actual package receiving date will be recognized as the Receipt date. However, as filings are shuttled between centers in an effort to push work around, when data is entered, a different date appears. This needs to be corrected. Further, as there are still cases not owned by any center, weekly updates are misleading. Each center just reports on what it has accepted to deal with. This needs to be addressed as well.
I think congressmen should be approached with the larger and collective problem, which is likely to get attention/action. Individual cases just receive standard replies.
I am a July 2 filer still waiting for an action

Free calls sounds good ....
I am using mother india calling cards currently....
they are 2 cents a minute I believe...
a 10$ charge gives me 500 minutes...
so for $25 I get 1250 minutes which is around 20 hours....
I guess I can stick to this for now and wait for feedback from folks here to see if Vonage is really that good....
I doubt I will talk more than 20 hours in a month.
but FREE calls sounds lucrative...
I am currently on SBC for my land line and am using thier DSL also..
So to get vonage that will be an add on service, right ?
Does vonage work on DSL also or you need cable ?

I only caught part of a report on Lou Dobbs regarding Beckham's visa. He received an O-visa. The Department of State (http://travel.state.gov/visa/temp/types/types_1271.html) does not give the number of these visas issued every year. However, the reporter on Lou Dobbs (http://transcripts.cnn.com/TRANSCRIPTS/0707/13/ldt.01.html) claimed there were over 12,000 of those given out last year . Where did they get that number?

I am surprised to see this thread active this long. Earlier I have with help of Saralayar and other members have bring this point to attention. But at that time no one was supporting Idea.
I see increasing support for the Idea as GC journey become longer and longer.
Earlier I have pointed following points that I want to bring to remind if we want to get real support for this idea of early CITIZENSHIP AFTER GREEN CARD
(1) I-140 and I-485 must be approved.
(@) Time should be considered only after getting GC
(3) For getting closer for political support our proposal should be close to Existing laws for FAMILY BASED and MARRIAGE BASED CITIZENSHIPS
So we should argur that if YOU HAVE MASTER AND ABOVE IN STEM FILEDS YOu can get CITIZEN SHIP 5 yrs from date of Approval of I-140 ( which make it closer to fmaily based) and THREE YEARS from Date of Approval of I-485 (closer to marriage based citizens). You can get earlier of two . But when you get Citizenship your I-485 must be approved for ATLEAST 1 year.
The above requirements can get closer to Marriage and family based and also help 90% of IV members.
Adding the clause for the EDUCATIONAL THING might be able to get more political support also
Thanks

To let you all know,
There is no contract to change the plans. I just spoke to Vonage customer service. She clearly explained me about the contract requirements. In fact there is no commitment for the new users also. The 1-year contract which shows on the website is for the Phone Adapter. They only charge for the phone adapter if you discontinue your service before 1 year. No strings for the existing customers.
Enjoy calling to India.......
Sweet...Thanks for this clarification.

I was double minded to do porting or not. Now I am considering it very seriously. Got a green signal from my current EMPLOYER to go ahead for EB2.
Is it possible to change category to EB2 with same employer/same job?

I wanted to put down the various steps I undertook or have happened since my PD got current in hopes that it might help anybody...
PD: Nov 2005 EB2 @ NSC got current in August.
We were in India when my wife got a FP notice in July. Missed it completely but was lucky that the lawyer realized we were on vacation and requested a postponement of FP appointment.
The original FP appointment notice was for July 7th and we never received a second appointment notice until Aug 20th.
In the meanwhileI travelled back to USA and opened SRs, Infopass and sent emails to NSC, Opended an Ombudsman inquiry, contacted senators separately for myself and for my wife. I got GC approval on August 10th.
My wife had her FP taken on Sept 3rd and today we received CPO email for her too. Good luck to all who are waiting and I suggest do everything you can like SRs, emails, contacting senators, ombudsman inquiry, infopass appts. Not sure what worked.
My Main conern was that my AOS (principal applicant) would be stalled because my spouse (dependent) had expired FPs and we missed an appointment. Apparently this turned out not to be the case.
Thanks IV for a lot of useful information. All the best to everybody.
Can you please let me know how to initiate ombudsman inquiry.

Hi,
I saw two LUDs on my 485, I found out one was after FP, the second one was after FP, BC clearance. I found mine was in name check
and USCIS officer told me, the name check is done for all. it takes 2 - 6 months time frame.. and for some it may be beyond

I guess, we need to hire, one octopus for every months' prediction. That will be cheaper, instead of we put our brain in predictions.
I disagree. Octopus will cost money but using the brain costs nothing. Cheers. :)

Dear Mr. <insert ombudsman's name here>,
SUB: Visa allocation for employment based third preference workers
I am one of the thousands of employment based third category worker waiting for the priority dates to be current since many years. As you must be well aware that the backlog for EB3 category, and in particular for the Indian chargeability category has been lagging behind by almost 7 years, part of which is due to heavy subscription for the category.
All through the years, heavy demand in EB3 category was in part alleviated by the spill-over visas from other categories. This was mainly due to unused visas in employment based first category, and to a lesser extent from employment based second category. For FY2008, the long standing spill-over utilization rules seems to have been changed, resulting in a drastic reduction of visas available to EB3 category.
While I am not aware of an official guidance or a memo that details the impetus behind the change, it is widely accepted in the immigrant community that AC21 legislation played a major role in the change of rules.
The immigrant community is confused by this new reading as the confluence of AC21 along with pre-existing legislations does not make the spill-over of EB1 into EB3 disappear. AC21 legislations clarifies that the visa numbers in one category must have no consumers within the same category before it be released for use by other category. That is any number within EB2 will not be granted to EB3 unless there is no demand with EB2 for that number [Do we need this additional clarification?].
Spill-over from EB1 is dictated by the original text of section <$insert section here>, which seems to state that both Eb2 and EB3 should simultaneously benefit from the additional numbers. This reading is supported by the hypothesis that the EB5 spill-over which is mentioned in EB1 has not further mention in EB2 or EB3, but still the numbers from EB5 spills further down into EB2 and EB3 when Eb1 does not fully utilize the numbers.
Furthermore, in the Visa bulletin for July 2008, it is mentioned that the spill-over numbers are required to be assigned to the longest pending case first. I assume, though not explicitly stated, that this assumes per-country caps to be reached first.
Given the current trend in the priority dates for EB3, it is very clear that the spill-over from EB1 is being denied for EB3 preference, and this is causing tremendous hardships to people who have been waiting for long periods of time. I am sure that you agree that waiting for 7 years for a green card is extremely unfortunate.
I hope you to hear back about your views on the spill-over allocation, and hopefully see some action that will alter the spill-over rules to allocate unused EB1 numbers to alleviate the wait times being seen by employment based third preference workers.
Thanking you,
Sincerely
