Number of H1B petitions approved for initial employment: 117,536
H1B petitions for intial employment where the alien was in the US: 62,292 (53%)
This is a good proxy number for H1B for applications filed by students who have studied in the US.
54% of applicants have a master's, doctorate or professional degree. 45% of applicants have a bachelor's degree
43% (a minority) of applications are from Computer Related Occupations
Median salary for H1B in computer related occupations: $60,000
Median salary for H1B in computer related occupations for initial employment: $50,000
Median salary for H1B in computer related occupations for continuing employment: $68,000
This proves that H1B employees have the power to negotiate raises and secure better working conditions as the median compensation for continuing employment is 36% higher than that for initial employment.
After seeing this data and considering the definition of median compensation, I think a good way to approach the problem of fraud is to audit all employers paying 5% below the median for the occupation.
For e.g. if the employer happened to fall into the low compensation bucket for FY 2005, then all applications from that employer for FY 2006 would face greater scrutiny.

I am a big supporter of Obama and a big fan and am eagerly looking forward to see him as our next President of United States. As a legal highly skilled immigrant what can I expect? Well, not sure if I would see myself living here anymore. I have been in the green card queue for more than 8 years now and still waiting. Will Obama's administration do anything for people like me to help reduce backlog? I doubt such a thing will ever happen. I would see myself and people like me discouraged and start packing our bags and move on with life.

I don't know what do you mean by success. as far as media coverage is concerned, Fireign media (India, China or elsewhere) doesn't help. It's local media, which can create some usefull awareness. If that is the case you have legitimate reason to take this matter with your local congress man if their legal cannot clear them.
Follow the suggestions of experts in this thread. I suggest you to contact your local congressmen. They would definitely help as in my case they did to expedite EAD renewal.

Our priority date is April 2006 and we'd received a RFE in 2009 which we'd responded in June 2009, however, still no update on our case status.
I'd opened a SR, send an email to Nebraska service center and also approached my local senator/congressman, but no update as of yet and just the standard reply.
What to do to expediate? We've been current for more than a month now! :(

Your response would depend on how badly you want this job.
Most times the hiring staff doesn't know the law and are too lazy. Anything out of the ordinary, they just reject.
If you want the job, you don't want to appear like a trouble maker. So, you could just write back politely that you were surprised by the disqualification since the Department of Homeland Security (do not write USCIS) had issued the EAD and enquire if they know that DHS guides employers against discrimination towards EAD holders. You can mention or attach form I-9.
Alternatively if you want to hold their feet to the fire, you can contact a lawyer. Hiring a lawyer should get their attention. Let the lawyer contact them. And also let DHS know about this employer. Write to them.
In any case, we cannot let employers come up with their own laws after we have gone through so much to get to the EAD stage. The law is the law and we are following it.

I understand your point. But this is exactly what anti-immigrants complain about H1Bs. ( depressing wages, outsourcing etc)
It is interesting that we are using anti-immigrant's arguments to pin L1s.
Thats NOT the key here ... its about violating current laws and regulations, do what ever you want offshore/outsource/onshore ...what ever, violating the rules and act of fraud is NOT ACCEPTABLE in any circumstances and we are pretty sure that ICE/USCIS and other agencies would have the same view.

1. If you drive one of those luxury cars that cost upwards of 25K and have paid it off. Get rid of it now. These cars depreciate more in dollar terms compared to cheaper cars. Buy a less expensive, no frill used car for 9-10K, put the difference in bank. That might bring in 10K of much needed cash. Even if you have not paid it off look for deals to sell and reduce your monthly payments.
2. Open an account at quicken online (http://quicken.intuit.com/online-banking-finances.jsp) it is free. Connect your banks and monitor ALL your expenses carefully. Find out what portion of spending is discretionary and cut down on it.
3. Hunt coupons, shop at Costco/Walmart (even if you hate the shopping experience). Avoid brand names and stick to Kirkland/Great Value. This might save you in monthly expenses.
4. Also, you can add cash by working part-time. I am not talking about those hard to come software moonlighting jobs. Any job that pays 10-12 an hour will add 12 x 4hr x 5days x 4 Weeks = $960 per month.
5. If you live in a duplex with a bathroom/bedroom downstairs, you can rent it to someone from local college/university. Underbid by quoting super low rent on craigslist and you can get $400-500 per month.
6. Use online services like LegalZoom (or Prepaid legal from work) to prepare contracts for rentals etc.
7. Cut down on travel/eating out and anything that you can live without. A little cash could go a long way.
Also, when it is hard to stay put and make payments, always remember there is a silver lining in owning a house too. If there is a hyper inflation (which is very likely) rents will sky rocket and salary might go up to keep pace with it, but your home mortgage frozen in time for next 20-30 years will remain unchanged and you could potentially have lower monthly expenses compared to renters. That's a bright side of staying put.

11374 will go to EB2
4) Quota for EB2 --> 5.72% x 140000 = 8008 + 11374 =19382, Pending: 47728, So total 28346 applications will still be
pending for year 2011.
5) Quota for EB3 --> 5.72% x 140000 = 8008, no spill over. Pending: 62607 -8008 = 54599 applications will still be pending
and pushed to year 2011.
Based on page 6, I do math as under for Mexico categories.

EB3 category.
5) Quota for EB3 --> 5.72% x 140000 = 8008 + 19489 spillover = 27497 – 7878 Pending = 19619 visas Extra.
6) “Other Workers” – Pending: 8415 TOTAL UNUSED VISAS = 19619-8415 = 11204 UNUSED VISAS will go to the quota
of other countries.
TOTAL UNUSED VISAS = 15463 + 1635 + 11204 = 28302.
Assuming these unused visas from Philippines, China and Mexico will be used for India, ROW equally India will benefit additional 14151 VISAS this year. Assuming all of these go to EB2 India Pushed down figure for EB2-India for the year 2011 will be 28346 – 14151 = 14195 pending EB2-I applications ready to go to year 2011.
One point, as we are seeing horizontal spill over for the last couple of years...so numbers unused in EB2 ROW will go to EB2 I and EB2 C not to EB3 ROW
So in your calculation ALL EB2 ROW/Philippines/Mexico unused VISA numbers should be spilled over to EB2I and EB2C not to EB3 ROW/Philippines/Mexico.

I am a july 2nd filer and filed my second application on Aug 15th.
Now that I have got receipts for July 2nd applications, I have put stop payments on the checks on Aug 15th application.
My hope is that my 2nd application will not be processed.
Hi, I'm in the same situation. I was afraid that my July 2nd application may be rejected or misplaced or ... so I filed a second application in August. Do you think that it's safe to put a stop payment on the check for the second application? I consulted an immigration attorney on that and he thought that it may negatively affect the first application if the second one is rejected. The attorney's suggestion was to withdraw the second application once the receipt notice is generated. Is there an option to combine both I-485s? Please, let me know what you think. Thanks, Leo

I got the RFE at last. I invoked AC21. The RFE for me is asking for 2 evidences
01. Why in Form I-693 medical examiner submitted x-ray but no skin test (we did it because we had the TB vaccination in childhood and skin test would come positive and we had to take x-ray anyway) ---Not an Issue, we can answer that
02. Submit current dated EVL for your new employer. No issue. we can answer that
For my wife also asking for 2 evidences:
01. About the same medical issue.
02. Provide her non-immigrant status between Feb 2003 to Jan 2004.
I don't know what do. Looks like we are doomed. My wife came here with H4 in 2000, was provided I-94 from the airport for 3 years (till Jan 2003), we didn't know then that we have to file a I-539 extension for H4 extension (even couple of my friends had the same idea). We knew that as long as I am on H1, she would maintain H4. I came to know in Jan 2004 and then we applied for I-539. I know this is stupid but that what happened. Anybody has any experience please reply..please please. We are really sleepless this time.

"involvement" ...how does that qualify some one to be president, I am not for McSame or Obama but I know one thing for sure... Who ever is the next president has his work cut out and what this country needs is a visionary leader, not some one with the same of what has got this country into this mess.
