Hi guys,
How long does it take to receive RFE letter by mail? Can we get a copy of RFE letter at the InfoPass appointment. I don't have patience anymore to wait. At least they can tell us what the RFE is about on the phone. These guys are trying my patience.

I just spoke with Xiyun Yang from Washington Post and conveyed thanks for covering a detailed article. She expressed that there is attention being drawn by many quarters including political for "Skilled LEGAL Immigrants".
Also we need to emphasize & communicate is the "increased fees" (almost doubled in many cases) for all USCIS services effective end of this month (July 30). Is this the penalty to be legal ?
The rallys and campaigns should emphasize this important detail too. This is huge money and not fair to the amount of service that is being currently provided.

I am also from India but the point I am discussing here is clearly a violation of law by Outsourcing vendors including IBM (not just Indian companies), TCS, Wipro etc. I work for a medium size consulting firm based in US and on H1 visa ...and I am impacted by these violations and I think I have the right to oppose this act.... to prove my identity shud I tell you my stories in Chennai consulate... or shud I tell u abt my days in b'lore or shud I tell you all abt my 24 years in India.. you can decide :-).
BUT regarding the L1 violation we have decided and this time the vendor is exposed to the authorities and justice is done. We have the support of good client managers who understands visa regulations.

There are some positive news regarding this bills.
(1) As some one mentioned despite tight dead line and pressure for Energy bill House committe is attempting to Markup bill which tells lot. They must have seen light at end of tunnel so they are taking risk. They will not touch if chances are less than 99 % becasue there are lots of bills pending needs action.
(2) As per NumberUSA Senate leader is doing some thing in back door. Means there must be deal going on between dems and some reps to pass Everify- recapture bill before end of sep.
(3) Last time when (9/10 ) when bill was about to discuss NumberUSA has big RED bar for action iteam . This time it is coming back and with no of co-sponser / favor increase , number USA is missing that red bar. Means they have accepted that bill will pass.
See first post by papau.. No of favor / cosponser are more now. So our calling is working.. There are some lawmakers that we need to focus. Spe. reps . Please call to them and once you think you are done and have little time call Those 3 anti lawmakers. I think we will see some light tomorrow.

What they did on Wall Street was short selling of stocks. This is nothing to do with real estate. Short selling of real estate is a way for Lenders to get the marlet value of the property instead of foreclosing it for no value at all. This is something which is approved by the lenders based on the market. Nothing illegal in it.

While a lot of people sending generic letters on this issue would certainly bring the underlying issue to the discussion table - the lack of "locus standi" would prevent ombudsman or even USCIS from acting.
Let me explain what I mean by the above statement - every case is different and is adjudicated according to the merits of that specific case alone based on applicable laws and procedures. So, investigation and even future policy direction can be only be based on specific instances of the entire case files and detailed specific reasons of how these cases were wrongly adjudicated.
So, the service centers and even the ombudsman is right in saying - we cant help till we have actual case #s

Here is my scenario :
We have a 3 year extension( H1-B for myself) and (H4 for my wife) based on an approved I-140 valid till Feb'2010.
I am going to apply for I-485(both) next month and EAD for my wife.
My questions are :
A) Do I need to apply for EAD for myself ? If yes, what are the benefits ? Does it help to have an EAD, if I decide to change jobs using AC21 after 180 days of filing I-485 ? Or any other benefit ?
B) Do I need to apply for AP for both me and my wife ? Can't we travel and then get Visa stamped for 3 years (till 2010) based on the I-797 that I have ?
Do we have to use AP only if we want to travel, once we have filed I-485 ?

Do you have F1 stamped or you just changed your status from F-1 to H-4?
My wife has H4 stamped on her passport which expired last year. We had got H4 extended last year, but has not been stamped. After that she changed status to F1 again not stamped. Now as per my lawyer's advice probably we will need to change her status back to H4.
My lawyer has suggested that it is not advisable to be on F-1 while applying for 485. You might argue that you are not the primary applicant ( on F1), and USCIS might buy that. But risks remain. Specifically if you have to travel out of country before your I-485 application is adjudicated you will have problem.
Since we all know that right now USCIS is just taking applications, and it might be mighty long time before applications are adjudicated, I have decided to not take risk applying on F1 status.

Think from your client's perspective:
1. Why should he pay you more if he can get someone for cheaper price?
2. Are you willing to do the same job for the salary that is offered by TCS, WIPRO?
3. If you screw up , who is responsible? What can you do to mitigate damage? TCS/WIPRO can replace the whole team at free of cost to make project successful.
4. YOU guys want to leave companies at will but the companies should not replace you at will?
If you were bringing in value to the client that they cant get from TCS/WIPRO then you will have the job. Get some more skills, be best in the business and be smart. Know what it takes for long term success. You have to be on your toes all the time.
STOP whining, you are just wasting time. All the best!

late last month my father passed away and I had to fly back to Australia to attend the funeral. My lawyer and I were already in the process of preparing my i485/ead/ap. They arrived at the service centre on may26 and I left the US shortly after midnight on the 27th ( talk about close). My lawyer told me that as long as I was present in the US the day that the Service centre recieved my applications, I was ok. I also had my L1 re-stamped in Sydney before returning.
So based on my experience, no you dont have to wait for reciept of filing, just must be in US when filled.

I had the misfortune of travelling thru London in December on my way to Mumbai. After I purchased my tickets, I learnt that I need a transit visa (TV) for UK. (Who is going to tell them (UK) that they are no longer the center of attraction esp. if you have lived and worked in US). Anyway, as per the rules, you need a transit visa if you don’t have a valid US visa. (Note: If you have AP, and don’t have a valid visa, you still need a TV).
I went to their site and did all the research to get a TV. Good god Heavens! Has anyone filled out their painful form for a TV? Besides asking the usual details, they get extremely nosy. They want to know each and everything about you. Where you work, what money do you make, name of your wife, kids and their citizenship status, name of your father and mother and where they were born, their birth date, how much money you have and where the money is (stocks, bonds, CDS) etc. etc. While filling up the form I realized that, even my future father in law did not pose so many probing questions to me. (Please note: I don’t mind answering these silly questions for a regular visa, but for the damn TV, it is certainly overkill).
Anyway to cut the long story short. The regular cost of TV is/was $92. However, when I filled up the application form they were asking for $184. (The satisfaction of getting a good deal on the tickets was quickly evaporating). I assumed I must have made a mistake in thinking the cost to be $92 and reluctantly paid $184. Next it was time to fill the application for my wife and answer the idiotic questions again. You should have seen the “I will kill you right now” look on my wife’s face after I woke her up in the middle of night and asked details about her parents. After I filled up the form, to my surprise, now they were asking $274 for visa fees. It was already 2:00 am and I have no choice but to painfully enter my credit card details, hoping that they would realize the mistake in their recon process and would reimburse the difference. (Of course, I was only dreaming).
It is now almost the end of January and I have still now received any money from them. I have tried sending several email to the emb(ass)y, but none of their emails work. I get bounced email for all the emails that I have used. I have tried calling them and left messages and no one has called back. I have send emails to my credit card company and the people who processed the payment and none of them have been able to help me. There is a way to talk to someone in the emb(ass)y, but you need to dial a 900 number, which BTW costs $2.49 per minute. Throwing good money after bad is not an option.
I just wanted to share this experience with you and remind you of the pain ahead, if you are travelling thru UK and don’t have a valid US visa. Personally, even if they had charged me the regular $92, I will still use other options to travel next time. The amount of time wasted in filling the crappy application form, going to NY, (starting Dec doing your finger prints) is simply too much to handle. Visiting your motherland/fatherland is a very special occasion and all these intermediate steps certainly water down the “good feeling” that you experience during the days leading to your trip.
I haven’t given up my quest for a refund, but now, not only I want my money back I would like to bring back home the Koh-i-noor too.

They even fingerprint you during the transit and they have special baggage scan at India when you return. But you know what things have changed. No body cares now for them when they come to visit India. This December when I was at domestic airport(small city), the porter came to me rather than going to a firang lady. Reason : desis give more tips now, like give 100/200Rs and the goras pay 1 USD :) and they know the maths.
Other incident, before boarding , a firang missed her baggage tag and when security lady asked for it, this firang was fuming and said it's their mistake. Now this lady cop, in her simple English said, Madam, please get out of this line, go to security check again, and get the tags, otherwise you won't be able to board the plane.
No one treats them as VIP any more back in India.

I received a response from the ombudsman. I am not sure if our issue is properly understood by his office. When we write about AC21 issues, the response talks about I-140 delays. Gurus, please help me understand the contents of the response below:
