    I do not show that we have data-entered Mr. XXX�s I-485 yet. The I-485 must be in line to be data-entered because we receipted an I-765 (LIN-07-245-XXXX).

    The I485 application is still pending at this office. Although the Department of State Visa Bulletin indicated visas were available for most employment categories USCIS still has to adjudicate every application. NSC has approximately 26,000 I485 applications that may have a visa available and we are reviewing them as expeditiously as possible. This application is in line to be worked but it will take time. Please allow an additional 45 days for NSC to adjudicate the application. If you have not received a notice from NSC after 45 days you may submit another inquiry.

    Sub: USCIS inefficiency for Legal Immigration


    I send my I-485 AOS application to USCIS and received on July 2nd 2007 at Nebraska Service Center, Lincoln, NE.

    It's almost approx 75 days since the application received at USCIS and have not received the Receipt Notice or any notification from USCIS.

    I tried to contact Customer Service at USCIS. They don't provided any information. USCIS website updates show they are processing 08/01 or later for AOS application. They are not following the First In First Out(FIFO) order.

    I need help of your good to know the status of my I-485 application.

    I know most of the ppl file EAD and AP along with I-485, but is it possible to file EAD and AP at a later time and not with I-485.

    I know it's a stupid idea but just curious whether we can do that or not?
    Also is the filing of EAD and AP also ties with your PD being current ?

    Today I have frank and candid talk with senator office staff. This time I put FIFO question in forefornt (becoz I know what she will hear from USCIS). She promised to raise the issue with USCIS senior staff. She requested to give my concern in writing again. Let's see if she makes any difference.

    Two issues raised with her in writing:

    1. My I-485 Adjustment Application was delivered and physically received to INS Express, Nebraska Service Center, Lincoln, NE on July 2nd 2007 @ 11:11 AM via USPS Express Mail (Tracking No. EXXXXXXXUS). It’s approx 90 days. I didn’t even receive the Receipt Notice from NSC. Please help me track the fate of my application.

    2. USCIS follows standard practice of First In First Out (FIFO) process. USCIS website reports issuing Receipt Notice for I-485 application received on August 2007. Why August received application are getting Receipt Notice and subsequent benefits (EAD, AP, etc) at the expense of July 2nd filed application? NSC have to work first on receipting and subsequent process of July 2nd application before NSC start working on July 3rd to August 17th Application. It’s unfair to applicant like me. I want honorable senator ask USCIS Management basic question, Why FIFO process is not followed?

    Either I will get a RN or my application will be back to me soon. :)

    I am a July 2nd files, they told me to call on the 3rd of October. (I don't know what is the logic to calculate 90 days at the USCIS). I am trying to make the attorney call that day. May be she will have more luck. :confused:

    Here is the response I got from my Senator in TX. Looks like atleast this senator is aware of what's going on. Is there anyway the leaders at immigrationvoice.org could arrange a meeting with him in Washington to see if he can influence our cause.

    In the wake of customer complaints and concerns voiced by elected officials, U.S. Citizenship and Immigration Services (USCIS) has informed my office that it is committed to ensuring six-month processing times for all applications and petitions by the close of 2006. Though the USCIS security check process is time consuming, USCIS reforms will not compromise national security in any way. USCIS officials reported recently that streamlining efforts, together with additional resources from Congress, have enabled it to reduce the backlog for many applications. Officials are confident they will achieve their goal for all applications. I applaud this commitment to customer service and look forward to a time when all who seek to visit or immigrate to America receive a prompt decision.

    It has also come to my attention that once USCIS approves a petition, many individuals must wait lengthy periods of time because of visa shortages. I recently voted to support a measure that would recapture unused visas from prior years a move which would reduce the overall waiting period for visas.     However, H-1B workers are legally required to pay the same taxes as any other US resident, including Social Security and Medicare9 (Publication 519 (2006) (http://www.irs.gov/publications/p519/index.html), U.S. Tax Guide for Aliens). Some H-1B workers are not eligible to receive any Social Security or Medicare benefits unless they are able to adjust status to that of permanent resident. However, if their country of citizenship has a tax agreement with the United States, they are able to collect the Social Security they've earned even if they don't gain permanent residency.

    In some cases, H-1B workers pay higher taxes than a US citizen because they are not entitled to certain deductions (eg. head of household deduction amongst many others).

    The author writes.

    "The ignorance to mention the stupendous contributions of immigrant high-tech workers was the primary cause for the anti-Indian atmosphere which is seen among computer professionals lately. Unfortunately, neither the media nor the public understand the foreign high-tech workforce. The net result: those who supported the foreign high-tech worker programs have taken a back seat to play safe, and Indians and others who came here on visas, and worked their butts off to make this country prosper are named 'slaves', 'dummies', and 'enemies'. writes the author, N.Sivakumar.

    The book also claims that bringing in foreign high-tech workforce at the right time was the primary reason for America's stupendous high-tech success, and gives statistics and evidence to prove that hadn't America acted quickly, the Europeans would have taken over the software dominance.

    The book also outlines the life, struggle and achievements of Indian programmers in America with entertaining facts, and is a prime discussion topic in many anti-outsourcing and immigration websites lately.

    I was talking to my COngressman's office. She says as per USCIS, they are trying to catch up with the huge backlog of 29th June to 7 Th August filers. They are hiring overtimers and Also using some volunteers from other USCIS dept to get rid of backlog. She said all the applications will be receipted in next 30-45 days for sure. She will again contact USCIS dept in 30 days to followup.

    President Takes Dual Tack on Immigration

    White House Seeks Tougher Enforcement,
    While Pushing Idea of Guest-Worker Program

    WASHINGTON -- President bush drew big applause during his State of the Union address with a renewed call for "a rational, humane guest-worker program" to keep the economy humming.

    But that appeal came only after Mr. Bush issued a much sterner one first -- for tougher enforcement of immigration laws, more vigilance on the border and an immigration policy that "reflects our values."

    The message Mr. Bush delivered to lawmakers is the same one an increasingly vocal anti-immigration chorus is sending to him: First get tough; then we'll talk.

    Mr. Bush was cheered by an unlikely alliance of pro-business Republicans, Democrats, unions and immigrant groups when he called for a guest-worker program in his State of the Union address two years ago. But the idea has hit a wall of opposition from the party's cultural conservatives and security hawks who first want to stop the flood of illegal immigrants into the U.S. (See related article.)

    In December, the House of Representatives passed legislation that would, among other things, extend a short wall on the border with Mexico to 700 miles. The Senate, which had planned to overhaul immigration laws when it takes up its own bill in a few weeks, now also is under pressure from some Republicans to toughen border controls first.

    As immigration soars to an all-time high, that get-tough argument is gaining political steam. With the 2006 elections still 10 months away, a half-dozen candidates are running for national office on pledges to stop illegal immigration. Bills on the issue, many denying benefits to illegal immigrants, have been introduced in 31 state legislatures.

    And polls show mounting voter unease about immigration: A December 2005 Wall Street Journal-NBC poll found that 57% of those questioned think the U.S. is "too open to immigrants."

    "It's astonishing how much this has become an issue across the country," says Brian Bilbray, a San Diego Republican who hopes to return to the U.S. House of Representatives this year after spending the past six years as a lobbyist for the Federation for American Immigration Reform, which wants to restrict immigration.

    But for all the emotion immigration is stirring up, political operatives in both parties warn that it isn't an issue that rallies voters. "Will this impact your electoral ambitions?" asks Ryan Ellis of the conservative group Americans for Tax Reform, who has studied the role immigration played in recent elections. "All history has indicated 'no,' whether you're in Arizona or Maine," he answers.

    It didn't prove a successful strategy for the Virginia governor's race in November. Republican Jerry Kilgore seized late in the campaign on the issue of taxpayer-funded job centers for illegal immigrants, and in a stinging television ad asked of his Democratic opponent, "What part of illegal does Tim Kaine not understand?" Although immigration was only one issue in the campaign, Mr. Kaine won with 52% of the vote.

    Likewise, in December, in a special House election in California's Orange County -- where illegal immigration is a flashpoint -- Jim Gilchrist, founder of the Minuteman Project, a volunteer border-patrol group, won just 25% of the vote.

    Mr. Ellis of Americans for Tax Reform also points to seven 2004 Republican primaries where immigration-restriction candidates never won more than 46% of the vote. Among those beating back challenges: Arizona Congressmen James Kolbe and Jeff Flake, who are sponsors of a House bill that would let illegal immigrants earn legal residency in the U.S.

    Candidates who want to restrict immigration seem not to fare well because very few people worry enough about immigration to vote on it -- even though many of them tell pollsters they're worried. In the Wall Street Journal-NBC poll, 78% of those questioned favored "tightening" the border with Mexico -- but only 7% said illegal immigration was their biggest national concern.

    Immigration is "a loud debate that produces few voters," says Frank Sharry, director of the National Immigration Forum, a Washington immigrants-rights group.

    But that doesn't mean immigration won't be talked about this campaign season. Most prominently among 2006 candidates, Rep. Tom Tancredo, a Colorado Republican, is toying with a symbolic run for the White House. Among other things, Mr. Tancredo wants to deport the estimated 11 million illegal immigrants now in the U.S. and deny citizenship to the U.S.-born children of illegal immigrants.


    Immigration restrictionists also have announced runs for governor in Colorado, for the U.S. Senate from California and for a smattering of House seats. San Diego's Mr. Bilbray is running in an April primary to succeed former Rep. Randall "Duke" Cunningham while also pursuing a class-action lawsuit that would prevent California public colleges from offering in-state tuition to illegal aliens.

    Some state legislatures are considering extending in-state tuition, health benefits and driver's licenses to illegal immigrants, even while others want to ban such benefits. In Ohio, a statehouse Republican has said he is considering an amendment to the U.S. Constitution to exclude illegal immigrants from the census counts that are used to apportion Congressional seats.

    Bills in New Hampshire and North Carolina would require local policemen to enforce federal immigration laws, and one in Virginia would require proof of legal residency to obtain a marriage license.

    With Republicans largely leading the anti-immigration charge, the issue is causing heartburn for the national party, which was hoping that its generally pro-immigration stand would help it pick up Hispanic voters. Twelve years ago, California's Republican Gov. Pete Wilson won re-election in part by campaigning for a ballot measure that would deny benefits to illegal aliens -- a rare instance where an anti-immigration stand won the day.

    But a decade passed before Republicans won the governor's office again, and they still haven't won back Hispanic voters. "It was a metaphor for short-term gain, long-term loss," says the National Immigration Forum's Mr. Sharry.

    Republican pollster Ed Goeas says he urges his clients to talk about solutions to illegal immigration instead of focusing on emotion-charged issues like immigrant job centers if they want to win. His firm, the Tarrance Group, does polling for several immigration-restriction candidates, including Mr. Tancredo, he says.

    But in anticipation of the 2006 elections, he's also running voter focus groups to help candidates handle such volatile issues as amnesty for illegal immigrants and whether to allow guest workers to eventually stay in the U.S. After voters let off steam, he says, focus groups show that immigration "becomes a very reasoned conversation very quickly."

    Not long ago, I used to get internet through phone line (Dial up connection). Now I get phone through internet. Isn't it amazing?
    By the way, I have been using Vonage for 5 years now and it is a great company.

    FYI...I heard from some of my friends that Vonage is good as long as you are its customer. Once you call CS and tell them you are leaving...they play all sorts of dirty tricks.

    I agree to what you say. The intend of this thred is not to support/oppose the outsourcing/offshoring the jobs. The intent of this thred is the fradulent use of L1s by the offshoring companies.

    If these companies play as per law then there is no issue. Everything is OK in moderation even outsourcing or offshoring. However these companies does fraudulent use of the L1s. They send endless people in L1s. Even if the person does not have hire/fire authority he/she is sent as L1A. General java/Oracle/.net developers are sent in L1A or L1B.

    These people with L1s are placed at client location and they work under supervision of client manager. False names are shown in the chart under these L1As benefeciary when they are applied for renewals.

    These things should be reported and should not be supported.

    Falsifying information is not right. If you have credible information and knowledge - write about this in detail. Let people know, what's going on.

    But I have already taken the promoton on Jan 2009 (raise and change in job requirements since I filed perm) and moved to the new eb2 position...I dd that after a year and half from eb3 485..... the job is same/similar but requirements and skills have changed

    but as you mentioned
    I should stll be ok and just make sure I interfile 485 after 3 years ?

    Is your 485 attached to EB3 OR EB2? Interfiling means attaching a new I-140 petition of new EB ctaegory TO 485 application attached to the old EB application to benefit the old PD with more advanced category.

    If the DOS has common sense they would be better off to retrogess for august, I am pretty sure they will be aware of the class action law suit thats gonna come upon them if they try to revise the july bulletin
