I don't think you need to fill it yourself. But, for the second question, someone with experience in dealing with RFEs should enlighten.

There are lot of people losing jobs because of L1. I totally agree with L1Fraud that we need to expose this racket and make sure everybody is following the rules, period....People like ganguteli must be on L1 and they will always support to continue this fraud. Bringing people on low wages on L1 is causing lot of pressure on salary and I have seen whole floors being replaced from this so called highly skilled people on L1. I'm not against immigration but against people/companies breaking the rules..
L1Fraud - Can you post on how to go about reporting this fraud. I know you mention about ICE? Do you have a format of letter and any suggestions on how to kick start the discussions and investigation....

That is naive... AC21 is not an administrative decision of USCIS... It is a law... AC21 = American Competitiveness in the 21st Century act!! It was passed by congress and the only body that can revoke it is congress.
USCIS cannot revoke AC21.. only congress can. Please dont be paranoid. The most USCIS can do is refuse to change their current stance on same/similar job.

I know that is ACT. But USCIS can interpret the provisions and make adjustments like what we are requesting. Similarly it can , IF THEY WANT TO, include a provision saying the job not only need to be in similar field, but it shall be in the same labor market because that is where you got your labor. I am not saying this is going to happen just because IVs effort.
If the intent of the similar job requirement is not to hurt the local talent because that is that job that is advertised for, the restriction of the same labor market will serve the same purpose.
That is a legitimate doubt and concern for some.
IV has not done anything that could have a negative impact on your green card processing. IV is striving hard to change your lives.
Shame on those who are scared or pessimistic. All you people do is to gaze at the sky and wait for the stars to fall.

No one want to waits anymore (it's already 93 days :mad: ) AND no one want to participate in any action to speed-up the process or put more pressure on USCIS to correct their behavior (USCIS will come back and screw your case :) ). Please tell me what you wants. :confused: Either please don't complain and wait till your Check Cashed :D OR organise and do your part, take some action to put pressure on USCIS. Choice is yours. :D

There are a lot of interpretations. Popular Attorneys like Rajiv Khanna and Sheela Murthy claim it is not valid and always advise clients to have a h1b backup. Not sure why they are so keen on h1b. It could be because some adjudicators may send EAD revocations also along with 485 denials.
Chandu, they may have other good reasons to do so, but one advantage for attorneys is an added fees out of filling for H1B; and for employers is less employee turnover due to the fact that even if employee is willing to change jobs. It is not so easy to find next job with H1 sponsorship than to be able to find one on EAD :)

He could have done the ethical thing and stayed in his present job and paid off his loan but he is choosing not to. And who does he blame for his situation? The concept of the "American dream". So the fact that he wants to shirk his responsibilities in favor of foisting his own debt onto the rest of the country isn't his own fault, it's the "American Dream" that's making him do this. It's not exigent financial circumstances that are causing him to foreclose, it is greed and shortsightedness (colloquially known as "The American Dream"). Greed and shortsightedness already caused him to go 20K under the water. And they will now make him screw up his own credit history. If someone cannot learn from one mistake, I say let him keep making mistakes. He will soon find out how difficult life in the US can be if you don't have a good credit history. As for the burden on us taxpayers, hey, we've been spending 10 billion a week for the past 5 years dropping bombs on people, what's a mere 20K?

Administrative fixes are a good idea.. I think the key to success in reforming the system will be a stealth and incremental reforms rather than any "CIR" type of fixes..

they first stated that they had instructions from their legal team that they have too much hassle with EADs causing problems, so they dont hire ppl with outside EAD. When I asked them to reconsider they said I dont know for sure, lets see what the legal team says.
It seem to me that this hr person did not make up the refusal on their own, but had previous precedents to go by or had been given explicit instructions.
My fear is that they will come back with a clearer explanation of why they cannot offer employment based on the EAD.
I am getting really really upset about this. If I had known about this EAD refusal thing I would not even have gotten out of H1 and would have continued to work...

That's true actually. They have no business asking you about details of what your work authorization status is. All they need to know is that you are legally allowed to work. Doesn't matter EAD, GC or US citizenship. Sponsoring for H1B might come up during the hiring stage but that doesn't apply here.
Hypothetically in an interview, if directly asked, and if I am planning on using EAD, I would simply tell them that I have authorization from the DHS to work for any employer, and leave it at that. If they persist, I will tell them that I have the required documents for I-9. No need for more details unless some kind of security clearance is required.
Its a little hard to understand how the issue of 'work authorization' cannot be raised during interview or hiring process.
- Say I am an employer who has a critical project that needs a person to be on job for at least few months, to ensure that the project goes smoothly
- The DHS/USICS/DOL or the Fed (or whoever it is) has told me that it is illegal for me to hire anyone without proper work authorization
- I may not have sufficient funds to sponsor H1B
- During the interview process I want to know whether the candidate a) has work authorization b) how long his work authorization is valid for? so that I can prescreen and not trouble candidates with the whole interview process only to tell them later that I can't hire them.
Based on the criteria above I dont see how it is illegal to ask what type of work authorization one has, and if EAD , how long it is valid. It may be illegal to disqualify a candidate who has EAD with validity for the required amount of time. But I sure can ask about the details within legal limits, can't I?
I dont think DOL or whatever dept it is, that regulates employment, can force an employer that they have to treat seekers of H1B Visa [and/or EAD people with for example only 1 month validity left] on par with US citizens (On the other hand, it is the vice versa that they are more concerned about :) )....I mean what if the financial position of the employer cannot afford him to sponsor an H1B or take the risk of employing an EAD guy with only 1 month validity and risk financial loss if that guy had to quit after a month due to EAD renewal delay etc.... Would they be forced to sponsor H1B or take a risk by hiring the 1 month EAD guy?
What might be illegal though is rejecting to employ EAD people with reasonable amount of validity left on their card.

There is nothing wrong in fighting. At least it will be used to prevent the same mistake in future. But it is not a bad idea to analyse the outcome so that everyone can prepare for that. My view is this campaign will be used for preventing future mistakes. I will be pleasantly surprised if we get more benefit than that. Even lawsuit also will serve the purpose and will give strong warning to USCIS.
I can tell many examples. Due to one persons misjudgment so many American and Iraq people were killed. Do you think they can get relief? Whatever relief people got it cannot bring back peoples lives. But still lot of people are thinking that Iraq could have been handled differently and many people are fighting against War. Most people realize mistakes after someone is impacted.
In the name of thinking differently we have smitha, senthil1 , asdqwe..and these guys confusing this struggle / fight for us trying to get ahead of the line or as senthil1 keeps saying uscis/dos made an honest mistake and asdqwe..keeps saying we need to fight for legislation rather than wasting time with these efforts. What all these guys and their ilk fail to understand is most of us are pissed off about the way it was implemented and handled rather than the ability to file AOS itself. If we sit and do nothing is like asking uscis / dos to walk all over us again and again. Besides in US law whenever there is a gray area, the decisions are based on precedents. This means if they have done this now means they can do this in any bulletin hence issued. They can issue a bulletin in Oct 2007 and on Nov 2 say "oops sorry my bad wrong bulletin" . Please come out of the basement and face the sun.

May I ask your immigration status. I believe you already got your GC and roaming around here just beat shit out of others. Each and every of your post is convincing me in that direction only. You would be happy to see the H1 guys thrown out from here. So it will increase your demand and you can make more money. Show me where have I undermined IV efforts? And show me nonsensical or counterproductive posts that I have made -- that is, nonsensical or counterproductive to the cause of upholding the law (not pandering to a particular employment category/chargeability area).
I have done my homework, and I have understood the law properly. I have time and again given logical proof, along with the text of the law, as to why EB3 is eligible get the EB1 numbers at the same time as EB2. On the other hand none of the detractors have provided proof, or material that shows EB3 does not qualify.
And for all those holier-than-thou EB2, what is about the letter campaign to get NSC/TSC to process application according to PDs (no lawful basis for that), and asking the removal of NSC bosses and what not. You seem to have different standards when you are suffering, and when others are suffering. There is a word in the dictionary for that, look it up.

I have taken an infopass tomorrow to get the I-551 stamp on my passport. Once that is done I will be mailing out the form I-90 for replacement.

Thanks for the replies fellas, this isn't a renewal I am talking about. This is the first time I have applied for an EAD. BTW, does anyone know what's involved in converting from H4 to EAD status i.e.
1. Do you need to apply for SSN before you take a job offer?
2. EAD by itself is enough to accept employment?
3. Can you take jobs/resign as and when you please or do you have to somehow get back to H4 status if you quit job on EAD?
4. Does use of EAD by H4, change non-immigrant status of H1 worker?
