Looks like a few people at USCIS know that some kind of masters degree from india with a 3 years bachelors unrelated to ones profession cannot be used in place of US masters. Did not realize that USCIS has some people who know the rules and play by them. If all USCIS people who approve these cases know about this and if lawyers stop justifying that correspondence masters degree is equivalent of US masters, bogus initial eb2 applications as well as porting could be stopped.

Hi, me and my wife we both r on H1b. My wife works with a solution & service LLC.say company A, now the owner is ready to start a new company, say B,with my wife as partner. She will be just passive investor in the company and getting profits, if any from company B. Can she still work full time with company A?. How can we invest in company B and take profits. Generally most companies are comfortable doing a 1099 on Corp to Corp than doing a 1099 with an individual. In both cases it is 1099 and company pays $$ as agreed.
There is one major difference why companies want to do business with consulting firms rather than individuals as the perception is when doing business with a firm as opposed to individual you deal with so many people (not just one) who share the responsibilities. If for some reason things don't work with the consultant the company can request the consulting firm to provide substitute so on so forth.
Also firms are perceived financially Strong, can afford $3M+ insurance (just in case something goes wrong) while individual may not be in similar position
it is always better to go with a Consulting firm rather than going individually (Pros certainly outweigh all the cons)
If you have a GC you can incorporate your own company and work ( If you are ready to take additional headache, If not better work for a consulting firm)

It was current for July. so i mailed my application on june 29, 2007, expected to reach USCIS on july 2nd, 2007.

Did you or someone you know experience such questions at POE for an advanced parole? Or are you just posing a hypothetical?
I have recently re-entered on AP and not a single question was asked. Not only that, I was not fingerprinted or photographed at the counter like a visa holder would be. I was taken to the back office where an agent entered information from my AP into the computer, stamped the AP and gave it back to me. No questions asked. Period. This was at the JFK airport in NY.
Parole is meant to grant entry to resume adjustment of status. Parole is not subject to employment, it is subject to a pending I-485.
If this is a hypothetical from you, then please shake these imaginations and live in peace and enjoy EAD and AP.
Too much thinking and too much analysis has caused this community to revert back to H1 lifestyle and they are not using EAD and AP - ONE OF THE MAIN REASONS why we were all so happy due to 485 filing.
What is the point of having an early 485 filed, if you are not going to use EAD and AP and be at mercy of consulates for restamping and be at mercy of employers who will need to sponsor you to hire you?

I agree, FP does not have anything to do with namecheck. I never received my FP for 15 months but inbetween when I took infopass - it was confirmed that my name check was done
I was under the same impression that it was FP that triggered the name check. But this is what the lawyer told them that their names were struck in NC and that is why they never got FP and now that NC is over they received FP notices. The interesting part is that within 3 weeks of FP one person got a notice that his application has been sent to USCISlocal office for further processing which I assume means interview notice in few days.

Most of the time anti-immigrats are calling and putting pressure on lawmakers who support any sort of immigration bill. That is why McCain, Brownback and many others backed out. Anti-immigrants are working overytime making it look like as if their opinion is the opinion of the entire nation. Each person is making 20-30 phone calls a week. But it is ok if none of us is doing anything. Lets all "time pass" and have this very important discussion about Rs/$ eachange rate variation... right?
Communities/groups/societies who do not understand the need to organize and standup for themselves always perish. Durbin-Grassley bill is just the beginning of the time for this high skilled immigrant community to disappear. Reason - When any group of people increases in number there is always another group which becomes its natural opponent/adversary. This community of over a million people also have very powerful opponent/adversary. That opponent is gaining strength and working overtime to purge all of us. It wont happen again. after encashing I485 checks USICS will start I140 PP again to keep cashing money. once I140 backlog will be done then they will earn from EAD renewals.

Thats what my Question is......how i am gonna prove it i paid 3k for my H1. They are deducting 500 (for my H1) everymonth from my paycheck in the name of CASH ADVANCE DEDUCTION.
I really want to teach them a lesson....so that they stop messing many vulenerable people like me who go to them every year. Could somebody tell me how i am gonna complain DOL in new jersey about this company and does DOL really takes any action.
Greencard is not i am much looking for......i am planning to go back to india after 2-3 years.

Here is the starting point. One way to do this to start from 'Wage & Hour Division' of US DOL. In NJ, this could be reported to the district office of US DOL at the following contact information.

A growing number of states now refuse to issue driver's license beyond the validity of I-94. that means that until your H1 extension is approved, you wont get it, because the new I-94 with new dates will come only after your extension is approved.
Now, in Arizona, they accept receipt of H1. In Nevada they dont. Other states have other rules. I know only about these 2.
You can upgrade your H1 to premium filling out a form and it will get approved in 7-10 days. Your employer should bear the expense of premium filing because the employer procrastinate and delay filing of extensions even though its possible to file extension 6 months ahead of expiration date. That procrastination should cost the employer or the lawyer, whoever caused the delay.
You cant blame DMVs for asking for latest I-94. That is the only way they can make sure they are not issuing driver's license to those who overstayed their visas and became illegals. The blame here lies at the feet of employers and lawyers who delay filing extension till the last moment. USCIS gives H1 extension in usually 3-4 months. If everyone filed 6 months ahead of expiry, there is no problem.

As of right now, YES. It is possible if you are in US. You submit the US birth certificate and that is the proof (Amendment 14) of your citizenship. If you are outside US, the process is slightly difficult that you have to convince the consulate/embassy.
Same is not true on the other side. Once you get US Passport, you have to do some "dramatic" actions to get your Indian passport back even if you are ready to renounce US Passport, because we follow rules (!!!) strictly.
