The Democratic opposition stems from the facts that the amendment proposed to re-capture from all categories and then re-distribute accordingly to a Republican preference. For instance EB-3, numbers re-captured didn't all go to EB-3. The amendment gave 61,000 to Schedule A and then re-distributed the rest equally.
A much fairer, simpler and permanent solution is to simply rollover the unused numbers to next years numbers.

Well, I don't think I am at the end of line of 300,000 people. There must be lots and lots of people whose priority date is after April 2004 might have filed. This includes 2004, 2005, 2006 and 2007.
So I think 3 years is intelligent guess. But who knows I am just trying to make myself happy and trying to stay positive.

Think of it this way. Conservative estimations say that in the recent application rush, USCIS received 300K applications.
That is 2 year's worth of applications alone, not including those already at USCIS.
If you compound that with the asinine 7% country limit, and assume that there are MUCH more than 7% of that 300K from Indian nationality - I'd say you are looking at much longer than a 3 year wait on average. I'd guestimate 7 years.
The only way this will change is to support the DC rally. We are getting major traction and positive news on this and it's potential affects. Please do everything you can to come.
There are people offering to pay 100% of airfare, there are free buses being set up. There are very few valid reasons not to come!

This is a bunch of baloney.
Whether this is a recession, a depression or a hyperinflationary cycle and economic wipeout, America will remain the pre-eminent world power in the next quarter century.
The US has the most trusted currency int he world(sometimes I wonder why, but the fact is it remains such or else its value should rationally be a lot lower right now).
It has the best universities and research centers, and remains a magnet to the worlds most motivated people.
It has the strongest military in direct face to face combat.
It has the largest, most well integrated, and diverse economy in the world.
Cultural differences while they exist are far less than many other democracies, mainly since this is a newer country built on diversity and tolerance. They have just elected Obama as president, if that does not represent the best of secular ideals, I am not sure what does. The US has a lot of cultural bonds in entertainment, sports, social programs like Medicare/Social Securities, Large corporations and brands etc that are remarkable cohesive forces.
This is a pure wish list from a bitter former KGB man, who is given a megaphone by an even more bitter Putin, who is still smarting from the disintegration of the USSR and wants the same for America.

Take home message for us guys is this: These are the people the congress hears out first when they want to make policy changes. These are the people who were able to convince NIH to double its funding in 5 years time a couple of years back. These are the people who are now saying that there is no job and money for US-born, so first get more fundingand training for us citizens, before you get foreigners to carry out research ...

Now that Democrats have taken the house and will soon bid adieu to rabidly anti-immigration Republicans in key posts like Sesenbrenner and Hastert, it does bring in a new ray of hope for us.
What this means for us in two houses:
Senate:
- To get anything done in the Senate, a bill needs support of more than 60 votes.
- Even if Democrats control Senate, which we will find out after a Virginia recount, they will really have to work in a bi-partisan manner. If we look at past trend the Senate was open to immigration reform.
Lower House:
- Due to "majority of the majority" rule by soon to be former house speaker Hastert, NO non-conservative agenda saw the light of the day in last congress.
-This effectively turned into a do-nothing congress.
- New Democrat speaker Nancy Pelosi brings hope for millions.
- This is a good chance for Bush to show what he can rally around all Americans not just the conservatives.
This election has shown that the American democratic system does work and that there is still hope for immigration reforms.
Maybe, this is too early to celebrate but I will go out and have an ice-cream :o some good news after a long draught

I stopped by at my congressman's office and conveyed this message twice (one letter and another verbal communcation as a follow up on that letter). (I am lucky!! his office is two blocks from my home as he lives in same town).

I agree that career development opps are limited due to economic reasons, but there is no way toronto or vancouver is any more racist than atlanta or miami. Who said there is no discrimination against white collar workers in the US as well .. if not how do you explain so many people supporting illegal aliens, but nobody breathing a word about us ? Lets face it , the corporates here need us but many native born white collar workers actively hate us. Thats how you have so much opposition to H1-B and EB visas from the likes of programmer's guild and other labor unions.

I returned on AP at the newark airport and nothing was even mentioned about it..infact AP is considered the safest way to travel even safer than h1b because you are technically not admitted to US but are "admissible"..There is a difference

Another person I know; he had H-1b and was working for some motels (he specifically told me he did IT work and wasn't working as a clerk and the company was a holding company with many motels). His case was transferred to local office. Local office called him and stated they wanted him to come to office next day. When he went they asked him why he was listed as an account signatory on the motels bank account. They thought he wasn't doing h-1b work and was doing unauthorized work.
My employer has made me an account signatory in one of his other company(a sister company of my H1company), so i can take the money out for travel expenses. Is that going to create any problem? I have my regular pay check coming from my H1 company.

Nancy Pelosi has long talked about her first 100 hour agenda and immigration is not on it. It would be amazing to see any immigration talk in lame-duck session.
Although, it would be a good start because both parties agree on it but I don't think the strategic think-tank in either party will rush to do that before seizing each other's deeper 2008 Presidential agenda.

Hello ,
yesterday i was watching Cspan 2 and debate about immigration.one of the senator (i don't remember the name ) was telling about a story of a woman with six children migrated from some poor european country ten years back to America.unfortunately her husband died after coming here.She move on in life and went to idhao and opened a cattle ranch and brought up her children well.Now she is very proud and successfull business woman and mother of six grown ups whom i am sure will be well establish them selves.
i listened the story and thanked the God that she didn't came on H4 VISA.otherwise she couldn't achieve the same.
For H4 this land is certainly not land of opportunity.Rather i suggest all H4 including my wife to burn their masters in business administration degrees and PHDs ,start doing cleaning jobs like illegals and eventually apply for Z visa.
Nobody is listening to us on capital hill .H4 are inanimate objects who came here to USA to accompany their fellow husbands or wife.No matter if it is for one year or 30 years.
And in the end no reform for H4 in this bill and no hopes for getting GC to their spouse.
I am not sure whether you should so frustrated that you should step aside and do other odd jbs just to get a "GC".

You really cannot ask for more EB3 numbers or 'treat EB-3 fairly'...Laws are made by the congress and they provided certain numbers to each country & category. USCIS has to follow these norms and apply those numbers and USCIS has followed the rule and have applied the allocatd numbers to EB-3. Problem is not that they are treating us differently or we are getting an unfair treatment. The problem we are facing is because we are just too many in number and the problem is Congress didn't make any laws to provide relief to people if one country or a category becomes hugely backlogged...unfortunately, the Last time they did any law for EB immigrats, it was in 1999 or 2000 when they brought AC21. Since then there has been huge surge in immigration but everytime anything immigration related legislation was brought in congress, it has been shot down..In my opinion we can get relief only if congress acts upon it, USCIS is working the way there were tld by the congress
