    How come we didn't have any phone campaign? What were our lobbyists doing?

    I'm glued to C-SPAN whenever anything related to immigration is going on in the senate. This time I wasn't aware of it.

    We need to be more alert this time. Maybe a phone campaign or web-fax campaign would have turned the scale! We gotta be more alert.

    Don't worry. This is not the complete defeat yet, since this ammendment ties into the troops withdrawl bill. The president would have definately vetoed the bill.

    The bigger thing is the SKILL ACT, which has yet to be at the floor. If we really want any success, we have to ensure that the immigration act is passed a a standalone act and not an ammendment to any other bill regarding defense.

    Absolutely wrong. Lot of misinformation here. You can very well apply for OCI for your child even if both of you are Indian citizens and the 4 steps mentioned above are just wrong. I would prefer OCI over PIO as mentioned in the other reply too, on PIO your child will have to register with the police station evry six months if stay is longer. OCI is valid forever while PIO is valid for 10 (or 5) years and OCI means you have all the rights but can't fight elections and vote.

    In 2005 my first kid got an OCI as the rules were diiferent then but in 2009 the current rule is that one parent MUST be a US citizen and I had to take a PIO for my second kid in 2009.


    Following is from the FAQ`s of Indian consulate at SFO

    6. Are minor children whose both parents are Indian citizens eligible for OCI?

    I would sympathize with you if you can do the following:
    1) Show me that no more than 90% of the population experience depression tendencies at some point in their life.
    among EB applicants I believe it would be 99%. So are you alone? I guess not:D:D

    Things you could do: Try watching talks with the Dalai Lama (available on youtube). Read books on Gandhi. Increase frequency of quiteness / meditation. Watch atleast one comedy show per day. Visit/remember the sick/disabled/poor or other less fortunate people than you.
    Things you could avoid: Heavy drinking. Watching news, movies/shows which are high tension. Most important is not to fight the emotions/thoughts that you consider are destructive. Allow them to come and go. Just watch them come and go........

    What you consider as "Good luck" can happen to you in the fraction of a seccond, however, it will never happen if you keep on defining yourself as unlucky. So focus on the good things you have now and refrain from comparing to "what you should be having or are worthy of having". :D:D:D:D

I follow similar techniques to stay optimistic for most part of time. but every once in a while, there comes a time when I think why do some ppl get so lucky in everything they do.... they succeed in everything they do. while there are unlucky ppl like the poor/disabled etc who are destined to live unfortunate life deprived of so many things that other ppl enjoy regularly. is this what they call 'Law of Karma' ? did I do anything bad/evil in my past births - did I destroy anyone's career or life ? I am positive I did not do anything bad/evil in this life .... atleast as of now :D

    The immediate reference to illegal immigrants right after mentioning high tech workers does convey a link between the two, no matter how you slice and dice the semantics.

    The article strongly suggests a link between high tech employees and illegal immigrants. That is very far from the truth!! Almost all high skilled employees are employed legally, and there are stringent and complex rules and procedures for gaining employment legally for a high skilled person.

    The woes of high skilled workers � delays of 7 to 10 years to get permanent residence in spite of following all the rules and contributing to society and taxes - are ignored by the media as well as politicians on left and right, allowing ill informed demagogues to set the agenda.

    Sloppy journalism by the likes of Mr. Harwood does not help matters either. It would do him well to research the subject well before writing in a story just to beat an editorial deadline.

    Democratic victory may pave the way for Bush's immigration plan

    WASHINGTON - If President Bush can find a silver lining in the Democratic takeover in Congress, it could be this: The outlook for enacting his sweeping immigration plan, which House Republicans blocked for two years, suddenly looks brighter.

    A 700-mile border fence pushed through the Republican Congress also could come under renewed scrutiny. Although Bush signed the fence legislation into law, Democratic leaders opposed the measure and may hold up funds for the project, which is expected to cost at least $2.2 billion.

    "I can't think of another issue that could bring together the Democratic Congress and the president like immigration," said Frank Sharry, executive director of the National Immigration Forum, which supports the president's initiatives. "This election has really changed the immigration debate forever."

    Pro-immigration groups such as Sharry's predict that the next session of Congress will be far more receptive to the most volatile elements of Bush's immigration plan: a temporary guest-worker program and conditional legalization for millions of undocumented immigrants now in the country.

    Since Bush first unveiled his intentions in 2004, those proposals consistently have collided with resistance in the GOP-led House of Representatives, which refused to consider a Senate-passed bill that largely embraced Bush's initiatives.

    Now Democrats will take over the House and Senate in early January under leaders who've expressed support for a comprehensive immigration overhaul.

    Presumptive House Speaker Nancy Pelosi, D-Calif., has called for legislation offering illegal immigrants a "pathway to earned legalization and citizenship" if they fulfill "tough requirements," such as paying fines and back taxes, staying employed and learning English.

    In a post-election press conference on Wednesday, Bush again listed immigration as a top priority, describing it as "an issue where I believe we can find some common ground with the Democrats."

    "I do think we have a good chance," Bush said.

    You have a little tricky situation at hand, but you'll be okay if what you wrote is true - Your employer will not revoke your pending I-140. Not only that, they have to be nice enough to respond to any RFEs that come for your case. they can state that the imimgration application they filed for you is for a future position.

    Also, USCIS has a guideline about these cases. They are supposed to see if your I-140 was 'approvable' if it had been adjudicated within 180 days or before you leave the company, which I think it should be.

    I understand there are some anxious days ahead for you, but If I had to bet, I would bet on successful result of your case in the end :).

    Just make sure that your old employer doesn't revoke your I-140

    BTW, when was your I-140 filed?

    The following is copied directly from a USCIS memorandum:
    "If the Form I-140 (�immigrant petition�) has been approved and the Form I-485
    (�adjustment application�) has been filed and remained unadjudicated for 180 days or more (as measured from the Form I-485 receipt date), the approved Form I-140 will remain valid even if the alien changes jobs or employers as long as the new offer of employment is in the same or similar occupation.1 If the Form I-485 has been pending for less than 180 days, then the approved Form I-140 shall not remain valid with respect to a new offer of employment."

    Looks like I-140 must be approved to use AC-21.

    I called them several times yesterday until I was able to get hold of a good rep. Most of these reps are rude and they dont even care to listen to what I was asking.
    The "good" rep told me that my case has been pre-adjudicated in the month of April and everything is all set and that they are waiting for the visa number. He said I might be getting another FP if it takes too long, but other than that everything is set. He did provide me quite a bit of information about my case, he told me that my name check and also background verification is also complete. He was even able to tell me how many EADs and APs have been issued to me against my 485. Hope this helps.

    Did you call this number: (800) 375 � 5283? The lady I spoke to did not give me any information. I guess I have to keep trying. BTW are you SRC or LIN ?

    Fact Sheet: Who's Looking Out for You?

    Green Card Visa Numbers Situation
    � The GC process involves Labor Certification (2-3 months) + I-140 (0-12 Months) + Wait for priority dates to become current (several years) + security checks (1 month to 2 years) + I-485 processing once priority dates become current (18 months to 3 years).
    � Yearly green cards quota for employment based applicants is 140,000. This includes visas for spouses and children. So on an average; it is given to ~ 60,000 families.
    � Country visas limit is 7%, with almost equal distribution for EB-1, EB-2 and EB-3 plus any unused visas from other countries. Generally speaking, for countries like India, approximately 7000 visas (~3000 families) were being issued every year in each of these categories.
    � It is estimated that approximately 500K+ (yes 500K) I-485 applications under skilled worker category were filed between July 2nd and August 17th 2007. Most of these applications were from people of India and China.
    � Employment Based Immigration reforms do not find enough support on the senate floors (Failure of SKIL, STEM etc Bills). As a matter of fact, it does not even get enough support to make it debatable, let alone final voting on the bills.
    � USCIS is a self-funded organization i.e. it is run on fees it receives and is short on resources.

    What do these jargons mean?
    � Priority dates will remain retrogressed for several years.
    � Those who could not file their I-485 now will now have to waitttttt�..
    � Due to resource constraints, security checks may take years.
    � Once PD becomes current, it takes on an average 1 year to 3 years to get approval.
    � Endless cycle of EAD renewals and Advance paroles.
    � For any reason, if any of your EAD gets rejected, you will need to stop working, In other words, need to leave your job.
    � You need to be in the same position with same job responsibilities for an indefinite time period otherwise you Green Card application will be rejected.
    � EADs are valid for one year and several employers (and rightly so) view it as a temporary permit and hence reluctant to hire you.
    � Once PD becomes current, it takes on an average 1 year to 3 years to get approval.
    � So virtually you have three options: a) Struggle for several years b) Leave the USA c) Join us.

    Agree on ur second point, however I was surprised with the context that "ok lets see how much we can buy the MS course and how soon can i finish it" as supposed to it will be great to do MS and lets see how I can furtherey ar my career with an added benefit of getting C in case of GC process.

    Again just my thoughts.

    How can some one further their career if they cannot take a higher qualification job because of AC21 constraints. MS or not i am sure that these people are qualified for better jobs, but they cannot advance their career because of lack of green card. To rectify that situation they are planning to do MS. So they are planning to do MS to further their career as you suggested which according to you is the right and moral way. I don't see any reason for surprise

    For upper middle class, OBC shouldn't matter much since you can afford to enroll your children in private schools and have them work in private sector once they reach an appropriate age. If they are US citizens, they can come back to the US anytime for education and/or employment.

    Talking of reservation and discrimination, what legal immigrants are facing in this country is not much different in my opinion. You can't even get your driver's license easily, let alone permanent residence. Most of us are here by choice even though we face all these issues in our daily life.

    FBI Namecheck status (not good news) (pg. 37 of the report)

    As of May 2007, USCIS reported a staggering 329,160 FBI name check cases pending, with approximately 64 percent (211,341) of those cases pending more than 90 days and approximately 32 percent (106,738) pending more than one year.40 While the percentages of long-pending cases compared to last year are similar, the absolute numbers have increased. There are now 93,358 more cases pending the name check than last year. Perhaps most disturbing, there are 31,144 FBI name check cases pending more than 33 months as compared to 21,570 last year � over a 44 percent increase in the number of cases pending more than 33 months.4

    And it is only 1 year of filing I-485 ( can i take comfort that many others have been stuck 2 year, 3 year etc ). ANother reason why visa numbers got wasted is that many fellas got stuck in namecheck ( Ask many of the Indian/Chinese/Russian folks ).

    I don't what crappy way they use to separate good from bad.
