EB3 + 5 years experience/MS = EB2
In todays schedules to come to I485 filing stage takes min 1-2 years. Let us assume 2 years. (personally it took 5 years)
So lets say 2 people (EB2 & EB3) apply for GC in year X. After X+2 they are eligible to apply for I485.
Let us say EB2 is current then EB3 should be current - 3 years. Otherwise the EB3 will have the motivation to refile in EB2 and clog the system further.
If EB2's PD is (current - 3 years), EB3 should be not more than 2 years behind (The time it takes to get to I485 stage).
I doubt people at USCIS have the time, interest or the inclination to understand this bit of simple math - As a result you will have people with multiple applications trying to to beat the broken system.

As I see, most of you are missing the point. Instead of trying to understand, you showing the maturity of mind. The whole purpose of EB immigration is to meet the Demand(Job opportunities) vs the supply(immediately available candidates).
When there are a lot of opportunities exists for EB3 level(skilled profession) and less opportunities exists for EB1(Ph.D/Executive Director), USCIS should give more no. of Visas to EB3, then EB1.
A country cannot be built with only the kings, and not even a home can be built with only Ph.Ds(Nobody do the dishes).

Fantsatic news. I think we have to unite for this big event - this is the BEST time to get our voice heard. If illegal immigrants are voicing why not We? Most of us are here for atleast close to TEN years and contributed for this economy. PERIOD.

Sorry to hear abt your situation. But buy some insurance either thru COBRA or just generally. Dont go to emergency room without insurance. Not a wise idea.
The last thing you want to worry abt is medical insurance.
I know couple of states like atlanta & texas with out having insurance also they will admitted the pregnent people.

I have followed it up with AILF and 3 more attorneys just in case to see if a law suit is feasible. All of them said, it is not possible. Only option left is to write to Dept. of Justice to see if this law holds a constitutional test. I wrote once, but never got any reply on that.
But if we could take this as a group and mobilise on a mass scale to reach out to DOJ and have them review this INA law we might get attention.
Couple of points to Nay sayers.. that this is not racial descrimination
INA even though uses country of birth instead of color of skin It is still considered raical because, Under the same INA, if someone is born in a retro. country and their parents are not from that country, One could use parents country of birth.
So if a family from UK on a business to India gave birth to a child, this child is not subjected to India limits. Which means this applies only to natives from India.
I tried explaining this in my writing to DOJ. But one letter didn't do the job required.

I agree with you. PenDot does not give online extension for non-immigrants(if it was mentioned originally that you are foreigner when you first got your license). Also they extend visa for H1 only after you get approved extension letter in hand. They do not accept receipt notice. I think they accept i-485 receipt notice to extend you Driving license though.

How are you trying to locate your record? Do you have your case number handy? Employer details, priority date - all that helped me find mine (rather helped me narrow it down).
I downloaded the 2004 file as you said and searched it, but could not find any information about my labor. Do you think the labor apps processed by backlog centers are in a separate file???

Most likely this saga of retrogression will be decided in the next 2 to 3 months when Senate / House discuss the CIR. If by July end nothing happens, it will be a signal for us to leave. I know this will be a good news for some since the queue will get shorter, but who cares. This country "was" the best, but the next "best" country is likely to be from Asia.
