I'm a July 2007, I-485 filer with PD dec 2004 EB3. I have been working as sr.project engineer for the past 4 years with an MI based company. At present my company is not doing good business started downsizing. i don't know when I'll be victimized. So, I have started searching for new jobs vigorously and got an offer for Designer position ( Permanent position with all benefits) with slight increase of pay. I don't have to use my EAD as employer is willing to transfer my H1B which is valid till 2010. Friends my question is -
There is a degrade in position, Does it effect my Gc process? I know, no one will be in this type of situation. my heart bleeds to accept the lower level position but, the fear of going out of job with wife and two kids is forcing me to accept the offer... If it doesn't effect my GC process..

Which center did u visit in PA?? I'm from PA also DL expires 9/30/07 along with H1..
PennDot Issued 1 year driver's license for both me and my wife. We took H1B 8th year original receipt notice, original employer verification letter and passports. PennDot issued 1 year license based on that. An entire family came from Hillside avenue and I dropped them in the night.
We will be doing more meetings in various places making sure there is enough majority and things workout
PLEASE FORGIVE US FOR YOUR INABILITY TO ATTEND.
You are most welcome to arrange for a meeting at the flushing temple. I will join as I live closeby, so will a lot of people. Let me know if you want to volunteer and I will help support.

I guess country quota is root of all our green card related griefs. everybody else can dream of getting a green card someday, but EB-3/EB-2 India & China should stop dreaming about Green cards...I am sure this can be prooved illegal.

I think the OP has some valid points. Certainly recapture lawsuit may work as the law does not say that allocated EB visas expire. Do not listen to nay-sayers, just do it.

You are right. Things aren't moving fast enough because there is a general lack of participation from the otherwise intelligent EB immigrant community.
Even if 20%-30% were really proactive in supporting IV, things would have moved much faster.
We need to develop really intelligent strategies considering all the factors. Just throwing out ideas and organizing rallys may not be enough (although needed).
There are a lot of intelligent people on this forum. I think we need to work on our unity, commitment and implementing of strategies.
IV is already doing lot of these but does not seem to be working fast and effective enough.

No I did not forget the pain of that LC. And I'll never forget that in my life either. All that I said was we should prioritize our issues. If everybody says PBEC issue is the once that should get more focus, I've no problem with that
either.

All EB3 and EB2 dates will be current next month for all of you except Mexico. Mexico will be current after drug cartel - law & order situation will be stablized. Stimulus Bill also has performance enhancing drugs for USCIS.

Well, there are many folks here including me who filed around first week of june.. I haven't heard anyone getting the EAD yet. I haven't seen any lud's after the receipts. Hopefully, one more week to go and then we are all good to get the 2yr EAD....

I am in a similar situation getting married in Sep07 and returning with my wife at end of Sep'07. It is little scary, as some say it might be risky not to apply along with the spouse.
Should I go ahead and apply for I485, EAD and AP all three at the same time now, or to apply just for I485?
I am not sure what advantage would be applying now, as I have to wait until the dates become current again, and I will not be able to use my EAD to maintain my wife's H-4 status.

I've the same question. It sounds pretty stupid that Indian government allows you to have Indian passport if you register the child within one year. Looks like the child has no say in the process. Also, once the child gets Indian passport, can she revert back to US citizenship and hold US passport by renouncing Indian passport? Or do she need to wait 18 years? Once the child holds Indian passport, then does she need to get US visa stamp to enter US? Also, can the child hold both US and Indian passport?

I am glad that some EB2 guys can empathise with us....EB3(I) is completely hopeless....but I doubt if IV will take this up...even a small admin fix like applying the spillover to EB3 this year...that will take away some stress on the EB3(I) pipeline....

All arguments are very sensible. No doubt about it. am working on an EAD and they did not incur any legal cost. However, I get frustrated thinking why they charge $180 per hour to the client.... even when the cost to company for me is about $110K per annum or around $60 per hour. I do not know whether I am worth $180 per hour or not....but probably more than $60/hr since they can charge $180 / hr
We really need to analyze this deeply if we want to come up with a strategy....

Ideally , if you want to find out how much you should get/worth , put yourself in the market and do interview and try to negotiate and see what the range you are being offered . You may not take the offer but at least you will know where you stand.
Be aware full time ( with all benefits) and W2 / C2C/ consulting rate are very diffrerent and another dimension is region for different rate.

This is the correct process of EAD renewal.
- get the latest form always from http://www.uscis.gov/i-765
- never use google or any search engine
- since my first EAD was filed before the new changes implemented last year (i think july 2007), I had to pay $340. I think everyone has to pay $340 (Your case may be different, read the instructions properly)
This now will give me a 2 year EAD. and even after 2 years If I dont get a GC, I will be able to reapply for EAD, at that time WITHOUT any FEES!!
Bottom line is : Read the instructions properly.
