Nothing is so simple.
Most clients have policies that require them to deal with only a preferred set of vendors. In some cases vendors are managed through a vendor management firm that classifies vendors into 3 categories. The highest level preferred vendors get the most billing rate per resource they provide. In addition, a vendor needs to satisfy a bunch of requirements like % of resources successfully placed vs the number sent for interview with the client, ability to have a certain $ amount of liability and workers comp insurance etc. Due to these factors, a client will not directly enter into a contract with an individual and that individual has to go through a preferred vendor. Now the individual (akak resource) could be tied to a lower level vendor who in turn sends him/her to the preferred vendor who then sends him/her to the client. One of the best ways to increase your hourly rate is to eliminate as many middle tiers as possible. Ideal situation is to work for the preferred vendor that places you onto the client. In most cases of preferred vendors this could only happen if you have a EAD/GC if they do not do H1s. A second best situation is to work for a Desi consultancy that works only with preferred vendors (aka only 1 level between Desi co. and Client). In these cases it might be possible to make almost as much hourly $ rate as you would make working for preferred vendor if say preferred vendor works 80-20 on Corp to Corp but works 70-30 on W2. e.g. Client pays vendor $100/hr, You work directly for Vendor on W-2 and Vendor pays you $70 (70-30 split on W-2). Now if you work for a decent Desi co. that works C2C with this Vendor and if the Vendor pays Desi co $80 (80-20 split on C2C) and Desi co takes out fixed $ (say $8-10) then you still get $70 in hand just like direct W-2 with Vendor. This is if you work on pure $ or % basis with a Big American Preferred Vendor like say Teksystems or TAC worldwide or Ciber or Keane or KForce or Sapphire vs salaried consulting with say Deloitte or Accenture or IBM consulting where the way it works is these big fish do not just provide resources (you) per position like a American Preferred Vendor does but usually take on a big project and then staff resources for completing those projects where they pay you peanuts (like $70-90k) but bill the client like an American Preferred Vendor.
In short, if you are someone who wants job security and doesn't want to look for new contracts on your own and like to travel, stick with Big American Salaried Consulting companies, but if you want to make more money and don't mind a little insecurity/tension/can interview often/ready to move then if on H1, stay with good Desi that works only with Preferred Vendors or if GC/EAD, work on W-2 (as pure $ or % split) with a Big American Vendor.

After incorporating the company in one of the states. What are the next important things one as a owner of the company needs to take care of especially if it is in IT product development area ( ofcourse including consulting but not purely comparable to predominent desi consultancy services)
Specifically in the following category:
1. If you are selling IT software products and services, what are the legal necessary formalities one needs to take care of?
2. How about expanding the branches in outside USA? May be a branch office in India to leverage huge technical resources? Any legal or other things to be taken care of ?
3. Bank Accounts next steps
4. Credits Credit Cards. What are the precautions one needs to take care of?
Any other thoughts....

In theory, the idea that a gathering of even 200 people in company's parking lot (Cisco, goolge, microsoft) - IS GREAT.
Immigration Voice has always appreciated efforts of members who get employers involved.
However, I am inclined to believe that company HR will resist such activity on their own premises, especially during business hours or even lunch time. That's because its loss in terms of productivity and distractions for all employees, even those who are US citizens.
BUT...
If someone pulls this off and if there is a gathering to protest green card delays at any of these companies -- Cisco, Oracle, Microsoft, Google, Intel, Amazon...anyone...THEN IV leadership will fly to such an even from wherever they have to fly and attend it at a moments notice (provided your employer allows us in your buildings/premises of course).
Not only that, if you can pull it off, then IV will honor you will a "IMMIGRATION VOICE MEDAL OF HONOR" for doing that. Its a square medal with imprint of GC on one side and EAD card on another side. :):)
So if you can, by all means, pursue that opportunity and email me or Aman on how we can help you do that. Microsoft has 3500 employees in green card wait line in Seattle alone. Cisco is also hundreds of employees in San Jose alone (and Cisco employees is one of my favorite groups of people in IV, they have shown up every where IV has done anything...must be something in the water out there in the bay area, its a land of activists...).
Thanks.

It's just bad luck to get that kind of CBP officer. It's upto you to ignore this or escalate it. In my opinion behaviour of CBP officer was wrong.
If you want, You can write letter to Commisioner of CBP about the incidence, following is the address :
http://www.cbp.gov/xp/cgov/toolbox/contacts/headquarters.xml
This happened in DC's large Dulles Intl airport.

It would make more sense to compare and brainstorm if you can post the skillset you have in mind and the rate you wish for?
I agree that being on EAD or having a GC puts a person in a better situation compared to H1B but the bottom line is the skillset in context, demand for that skillset and expertise that one has in that skillset.
it depends on the skill set and your experience. I accept the fact being on EAD or GC will give advantages. But I dont think GC only make the wonders. you might get 10-20% extra.

no you dont *need* an accountant... but accounting is a lot of work and if you do not understand the law and the IRS, then you could get into trouble with bad accounting...
Do you have to go thru an accountant to start a company?

These are not going to fix the issue at large about limited GC numbers.
We need to make sure bills like HR5882 get passed. So we need to focus on how to make this a central issue in current politics.
We need to do much bigger than a single day news ... something for which main stream media pays attention in +ve light.
I second this. It will take 1 more year for USCIS just to come out of 2001 for EB3 I unless 5882 passes!

And they note your name on the degree and next you know is you are stuck in FBI name check forever :D
I guess using our degrees to pass on a message is a fool-proof idea. That can immediately catch on with media like flowers did. If not stoppers, we can write our message in bold colors on the degrees.
Indeed thoughtful. I'm all in for it.

We should this opportunity to get the USINPAC to join our fight for timely immigration benefits. Now that IV is an established voice for the immigrant community, hopefull USINPAC will be ready accept IV and join the us.
GIDOC, Again, don't do this mistake. Talk to people who know this org before suggesting anything like this. usinpac guys had all the time in the world to work on this issue. But all that are bust doing is - doing photo-ops with lawmakers. HELLOOOOO!!!! Paid employees out there – are you listening????
If you want IV to really do something, please don't even think of..... it will be just a huge mistake....
IV core,
Please do not even think of even trying this idea. These guys are going to corrupt this org as well. PLEASE PLEASE talk to other people to find about the reality of these con-artist.

I diagree with you...Indian film Industry have very good directors, They are no way inferior to Hollywood. Firstly you can't compre them with Hollywood because they have differen audiances...Hollywood have money power so their movies are technically better, but as far as quality of movies Indian film industry is very good...It caters to all tastes. There are Shyam Benegal, Basu Chaterjee, Govind Nihlani for people who like simple senseful movies there are Karan Johar, Yash Chopra, Mani Ratnam for expensive, hip hop movies. There's RGV, Hirani, Rakyesh Omprakash Mehra for different story based movies. In my opinion caters to wide variety you need to pick up by your taste...None of the Amitabh Bachans did any thing for slums,Danny Boyle Made a very good movie.I think the fact is Rehman is a prodigy no doubt about that, he makes very good music we all know that.As compared to Hollywood directors Bollywood directors are subpar with the exception of very few good ones. Movie business is controlled in India by few families, what ever the movies they make rest of the people will watch it.I dont want to open the bollywood can of worms.Movie directors in India are usually sons of Bollywood actors or some one related to Bollywood.
I am sure none of the Bollywood directors would ever be able to make good movies, they dont have a global outlook, neither the needed juice. usually Bollywood directors are some low key high school drop outs who have connections with mafia.
If some one who is reallly talented is not going to make it in Bollywood,Southern Film industry is even worse.

My daughter has received her new US passport. Her Indian visa is in her old passport. I understand she can carry both passports with her to India and does not need a new visa. Am I right? Thanks.
You can also get new passport number added to PIO card. So that you need not carry two passports.

1) I downloaded the form G-639 from USCIS website just now , after briefly going thru it seems like just I-140 approval copy should not go above $25 , may be less. However much complicated requests will add higher costs.
2) No, employer will not get to know. I dont think they sends anything like that to employer. After all you are the beneficiary of the I-140 petition. Its not that you are getting "Tax Returns for Company" by using 3rd party tools.
Rather moving forward USCIS should make it a rule that I-140 should be shared with the beneficiary as well. I-140 is meant ONLY and ONLY for you.
Hi Diptam and others, few questions about FOIA,
1) My employer does not want to share the original I-140 either, so i too want to apply via FOIA, do you know what is the cost of applying ?
2) If we apply, will the employer get to know ? does uscis send some notification to the employer that the employee requested a copy of I-140 approval notice?
Thanks, has anyone successfully got it back ?

500 Eb1 numbers are unused
500 numbers spills to Eb2
There are no 100 Eb2 India cases and 50 Eb2 China cases and Eb2 ROW/phillipines/mexico is current
Now Eb2 India+Eb2 china uses up 150 numbers and
350 numbers spills to Eb3
Now there are 1000 Eb3 India cases from 2001 to 2003
Eb3 china,ROW etc there are 1000 cases fom 2003 onwards and none from 2001 to 2003
As spill over needs to go by PD Eb3 India takes of the 350 numbers and may be moves by 1-2 months and Eb3 ROW doesnt get any because no older cases.
DISCLAIMER: this is only illustrative and highly oversimplified, Actual scenario will have many many variables
OK thanks for this explanation. I think I need to get a few drinks now!!;) Thanks ags123

You mean to say sell US real estate for GC/citizenship? I don't see this going very far. I can see anti immigrants waiting for this one. Best is to lobby using aides of big corporations, developing relationship with lobbyists who already have connections, hiring lawyers, developing strong case, donations in election campaigns etc. All of this needs loads and loads of money. Are we ready to donate to IV and build strong lobbying group for our cause? That is the only way to change our current situation.

According to my lawyer, the person (in this case your wife) must be in USA until your wife's AP application is accepted. Basically your wife should not try to apply AP when the she is not physically in USA.
After the application acceptance, your wife can travel.
Disclaimer: Please do not take this granted and always consult your immigration attorney.
I would like to differ on this, the person applying for a renewal of AP does not have to be physically present in the US until the AP is approved. Our attorney confirmed this and if you notice on the AP application form it states if the document has to be mailed to a different address other than USA.
Our attorney said one can apply for a renewal even from a different country, the clause that one has to be physically present in US is only for the initial I485 and AP application.
I have applied for AP renewal on June 23rd and am traveling next month to India for 2 months will be back before my current AP expires i.e. Oct 10th. My attorney actually asked me to apply for renewal before I leave for India.

Hi,
Is it possible to apply for both PIO and Indian visa simultaneously. My problem is that my son born in US has to go to India in 60days. If I apply for PIO and if it will not come in 4 weeks is it possible to apply for Indian visa and then go to India on Indian visa ?
Thanks !
You can do that, if you are applying in Indian Consulates and not in Embassy in Washington DC.
1. Washington DC still requires ORIGINAL US PASSPORT (At least, they make it clear)
2. New York : Existing (valid) passport in original, along with a photocopy (Skeptical)
3. San Francisco : Existing valid passport in original, along with a photocopy (In the application form, it says for minors, send Photocopy of US Passport) (Still skeptical)
4. Chicago : The copies of first two and last two pages of foreign passport should be enclosed. (Nothing skeptical as in New York)
5. Houston : A notarised copy each of his/her birth certificate , his/her parent's latest Indian passports (either expired or not yet expired ) and his/her current US/Foreign passport and a copy of the parent's valid passport. (Guess nothing is skeptical)
Bottom line, for a US born minor, with the birth certificate + copy of US passport (notarized) are enough to give a PIO card. But the above offices of same agency follow different rules.

He called it garbage can out of bitterness and perhaps a little sarcasm. Obviously this is very important to him, otherwise he wouldn't have vented to perfect strangers on the internet. Have you never really wanted something and lashed out at it out of frustration?
