    Guys MY PD is feb 2008. I am recently watching vias bulletins. I am in EB2.
    Based on my watching previous visa bulletions ( after sep 2008) I dont see that it makes major difference if you file in EB3 or EB2.
    Both are backloged very much and sincearly I dont hope inspite on being in EB2, I will get EAD or GC till 2015.

    What are your thoughts, is it worth filing in EB2?

    I think it's worth filing in EB2 if you can. The way spillover is working right now, EB2 India is greatly benefitted. Also whatever data someone got from USCIS (through senator inquiry), there are less EB2 India pending (~50,000) than EB3 (~70,000) until July 2007.

    Last year India EB2 got ~15000 visa numbers. If the trend continues then within 3 years India EB2 cutoff will reach 2007. This is way better than EB3I, which I don't think will cross even 2003 within next 3 years.

    Please contribute for FOIA cause, which will give us more data for predictions. Hopefully we can predict with 80% or better accuracy once FOIA data is with us..

    I went through the Federal Firearm Law and here is what I found:

    (d) It shall be unlawful for any person to sell or otherwise dispose of any firearm or ammunition to any person knowing or having reasonable cause to believe that such person�

    (5) who, being an alien�
    (A) is illegally or unlawfully in the United States; or
    (B) except as provided in subsection (y)(2), has been admitted to the United States under a nonimmigrant visa (as that term is defined in section 101(a)(26) of the Immigration and Nationality Act (8 U.S.C. 1101 (a)(26)));

    (y) Provisions Relating to Aliens Admitted Under Nonimmigrant Visas.�
    (1) Definitions.� In this subsection�
    (A) the term �alien� has the same meaning as in section 101(a)(3) of the Immigration and Nationality Act (8 U.S.C. 1101 (a)(3)); and
    (B) the term �nonimmigrant visa� has the same meaning as in section 101(a)(26) of the Immigration and Nationality Act (8 U.S.C. 1101 (a)(26)).

    (2) EXCEPTIONS: Subsections (d)(5)(B), (g)(5)(B), and(s)(3)(B)(v)(II) do not apply to any alien who has been lawfully admitted to the United States under a nonimmigrant visa, if that alien is:
    (A) admitted to the United States for lawful hunting or sporting purposes or is in possession of a hunting license or permit lawfully issued in the United States;
    (B) an official representative of a foreign government who is:
    (i) accredited to the United States Government or the Government's mission to an international organization having its headquarters in the United States;or
    (ii) en route to or from another country to which that alien is accredited;

    101(a)(3) The term "alien" means any person not a citizen or national of the United States.

    As per my understanding, if you are legally in the US, you can own a small firearm...walk into a store and tell them u need a gun and they will tell u what paper work you need or go to your local police station and ask the requirements.     Whether we like it or not...this is a reality. I have had a neighbor where both the husband wife was working. They brought their parents every year... because it was cheaper than Day Care.

    But they didnt bother to drive Benz and BMW.

    True, have seen many folks do the same.
    Though their pride says no. Not sure what's so shameful in that :)

    CIS director is saying that he has made arrangements to pass on the flowers set to CIS office to the US war-wounded soldiers.

    I think we should start a blood donation campaign to impress upon him that aspiring immigrants will not be found lacking in caring for the US army soldiers.

    I tend to disagrees with your comments, firstly please dont call this a stupid event, as a lot of young students strive to win this competition. In order to lead you have to follow, I have come across some smart ass Indians who love to talk and give directions, but they miss whole chunk of substance in their directions. (I don't mean to target you or disrespect any one else up here).

    Your commments on parents motivating their childeren to strive for success in their lives, their is nothing wrong in that, would you rather have them go smoke dope and jerk around to waste their time? I am indian and proud to be, , above all proud that my parents pushed me to excel and do better with the opportunities granted to me.

    However it is some desi companies who brought in the trend of lying and faking to get thie ways. But believe me , they dont get much further in their lives. I am glad strict restrictions are imposed on these companies, and the type of consultants they bring on board.

    Is it fair that the person doing Masters from this country be put in the same boat as a fresh of boat from India?

    First of all, you dont have a binary choice in the matter such as either you learn 50,000 words and their spellings or go smoke dope. There is a middle ground here.

    Secondly, why do I see in company after company, especially in the knowledge industry that a straight A student, like your Kavya here, working for a manager who had been a B- student who in turn works for an executive who was a C- student ?

    Get educated ... that's fine. But dont get over-educated such that you are a cripple who cannot think outside the box. Too much education, too many straight As, too many spellings will make you incapable of thinking outside the box, taking risks. Anyways, that's my belief and my opinion and everyone is free to raise their kids in whatever way they deem fit. I for one, would never ask my 2 children to participate in any spelling bee contest.

    As far as your desi company thoughts go, it has nothing to do with spelling bee topic. However, let me tell you this. By being holier than thou and telling other people "I got a degree from here and you dumb asses have never been to an American college, so get lost you idiot, this job here is mine..." does not help anyone. Also, no desi companies put a gun to the head of anyone - Indian educated or US educated - to work for them. And let me remind you, there is AN ENTIRE GENERATION of US educated US masters degree holders who had no job after graduating and have been to a desi company to get trained on the real-world software applications. I am sure you know some people yourself, just as I know some people in that situation. If the US masters degree made them super-duper smart, then they would not be knocking doors of desi companies for education after graduating.

    I am no fan of desi companies, everyone here knows that. But don't preach a holier than thou sermon to everyone who doesn't have a US degree. Because your US degree isn't worth a bucket of warm spit when it comes to getting a job.

    msgs like this help establish the notion that this is an indian website dedicated to indian immigration issues. I didnt see any post wishing happy Eid/ Eid Mubarak nor did I notice last year that anyone wished a Merry Christmas/ Happy Holidays, nor do we wish our Chinese friends a Happy Chinese New Year.

    As Diwali is national holiday in india... same is true for Eid and Christmas.
    Would greeting on Eid or Christmas will also set the notion for Indian website ?

    Lets not hope for results just act. If Gandhi could drive Britishers out of India using this approach, USCIS is also made of human people and sure they will do something to lessen our pains.

    The British were a bit smarter;). Here we have problems explaining to the average American (which include the officials of our Senators and Congressmen), the difference between h1B and Green card. Everytime I send a fax to the Senator regarding the Green Card, i get a reply about how they do or do not support H1Bs.

    In this whole flower sending campaign, we want the message to be LOUD AND CLEAR. Gandhigiri alone did not drive the British out of India and even if it did, let us not forget in that case the British were on Indian soil, here we are doing Gandhigiri in another country ON THEIR SOIL!!

    a 20 year old girl had injuries because of acid attack on her and she was in hospital praying god to save her life.But she died finally(http://www.hindu.com/2009/01/01/stories/2009010150460100.htm).

    If god exists , he/she should listen the prayers and save people.

    This is just one example.There are millions of incidents which proves that GOD doesn't exist.

    It's just out belief that GOD will do some good for us.

    problem is that if we believe in GOD , we'll start living with false hopes.

    I don't know how to open a thread to run a poll to track the number of people ready to send flowers to white house/president to highlight our case to buy houses if there is a a provision to approve GCs on a fast-track basis. With a substantial fast track fee (>4000 dollars) and 20% down payment toward house payment, we have a strong case. If we get hundreds of people ready to send to flowers, may be IV can make it an action item.

    I wish but my assumption is that One's PD have to be current atleast 6+ more months then there is a good chance for an approval, other than that we have to depend on our Luck ( I think we can predict the Powerball or Megamillion winner much easier than USCIS process)

    I wish your case would have been approved long ago, Your signature tells me that - EB2- I PD Dec 2003, and your PD was current for a while but still no luck.

    If nothing comes up...Check if your original employer files New I140 to consider you in EB3 instead of EB2 using same labor.

    Even for that Nebraska expects a single source degree apart from 16 years of education for bachlores.

    If the H1B Visa allows you to work here for 20 years, if spouse can work on H4 visa, you can get in-state tuition for studying, and you can claim the money you contributed to Social Security anytime you decide to leave this Country --- WILL You be in the LINE for Green Card
