true, my green card was filled EB 3 Software Engineer, today I am an architect, jumped 3 level up . I dont know why you can't get promoted.
You can still get promoted while on H1B just don't give up hope. If you're not getting promoted even if you're performing well, then there's something fishy going on with your employer.

To me here is KEY.
Either Country cap or recapture will end current backlog for India and China.
If both are pass then no more future backlog for india and china given that H1b limit stays 65k and strick rule for l1a / b
if none passes then no more chances for Eb2 with PD later 2007 and Eb3 with PD later 2004.

Regarding Mathew Oh comments:

How do you think the passage of the DREAM ACT could impact our situation ? If they pass this, they would allay a sizeable portion of illegal immigrants to get amnesty through their children (few millions). I am just wondering whether the illegal alien supporters would lose steam to support CIR after this ? Ironically, they would get a sizeable amnesty, overhelm USCIS with millions of applicants and probably make the passage of a CIR bill more distant. I can't think of something less advantageous to us than this. I hope I am totally wrong.
What do you guys think ?

Recent mid-term elections resulted in wins for the Democrats, who will take control of the U.S. House of Representatives and virtually the U.S. Senate as of January 2007. The ensuing two-year term, many believe, may be ripe for some sort of comprehensive immigration reform. President George W. Bush has been espousing all along the cause for comprehensive reform in this area. Most people recognize that there are immigration problems and governmental delays that exist. Most also believe that the system needs to be changed for the better. But just how this should be accomplished is not so easily agreed upon, and so it is a hot-button issue. Many of the hardliners, who took a strong anti-immigration position, lost the recent elections. But there are some who took this stance and won. It also is widely believed that many of the newly elected Democrats expressed anti-immigrant sentiments in their campaigns. Achieving any strong pro-immigration measures may prove to be more daunting than originally was anticipated; certainly more than many hoped it would be. Needless to say, we can expect 2007 to mark the beginning of a time for change and flux in the arena of U.S. immigration law. There is a possibility the DREAM Act could be passed, allowing the children of undocumented immigrants (who complete their high school educations in the United States) to obtain conditional "green card" status if they enroll in college or join the U.S. armed services. Both the Democratic and Republican parties seem inclined to help children. There are individuals, however, who are not willing to give any benefits to children of undocumented immigrants. My wife has a H1 since oct 2006 till date she hasn't worked and hence has no pay stubs. her passport has a F2 visa. I want to convert her visa to H4. Her employer is asking for 6k to generate 3 paystubs for 3 months. I dont want to pay so much. if we go to canada to get H4 stamping will they ask for her pay stubs or just my pay stubs are enough.
Is there any chance of rejection. also can I go to canada for stamping or do i have to go to home country.
is there any site or posting that explains the process of applying for H4 in canada.

I requested IV to help us on this just like how IV did for the EAD cause. We all appreciate how much IV has done for us and helped in getting EAD renewed on time for so many people, may be this is something that they can take up. Here is Pappu's response for my request..

This is my thought process (also referred by Ron G):
July 2007 brought in approximately 500K 485 cases.
We do not know how many cases were pending as of June 2007.
Fiscal year 2007-2008 USCIS used over 140K EB VISA numbers (I think it was around 155K).
Fiscal year 2008-2009 USCIS will use atleast 140K EB VISA numbers
so, 500K - 300K = 200K.
Assuming USICS approval rate is 85%; 75K of 500K are denied.
200K - 75K = 125K EB cases pending from the July 2007 cases.
Additions: from all current categories - may be 25 K in 2 years?
So, 150 K plus whatever that was pending as of June 2007.
So next fiscal year, 2009 if USCIS uses the quota 140 K, most or all of the 2007 filings will be cleared. If not EB3 I, definitely EB2 I and C, EB3 ROW will be cleared.
Depending on new filings, EB3 I might retrogress but retrogression might come within 3-4 years instead of current 8 years.
I strongly believe, beginning Jan 2010, dates for EB2 (I and C) will move forward heaps and bounds followed by EB3 ROW.

If you think this is hell my friend you are in for a rude surprise.
When you want answers for your question there is a method for asking it, pls follow that method and you will get your answers, there are more people willing to help here than you will find anywhere. Ranting about communities will get you no where, now apologize and ask your question, someone will answer.

Honestly though, OP's proposed law would get much more congressional support than EB reform.
If first you gave amnesty, and then allowed ppl to sponsor their parents on a GC, the illegal immigrant lobby would be very very happy.

I watched the entire fiinal. Apart from kavya my favorites were Kyle Mou and Tim ruiter. This was Kyle's last chance, but I hope Tim wins next year.
Just thinking aloud : Out of 11 finalist 8 were kids of immigrant parents (7 of them indian). is it just co-incidence ?
I hope after watching this, americans should now have no doubts that imiigrants are here not because they work for less but because they are good at what they do and they are hard working people.
This whole spelling bee thing is the stupidest thing I have ever heard of. By any standards, it is pure and simple torture to subject the kids to memorizing thousands of words and their stupid spellings. And what use is that? Have they never heard of something called SPELL-CHECK in Microsoft Word and other email services ?
Or are they afraid that their kid will go to a job interview and someone might ask them to spell the word that no one on the planet ever uses and is only present in the Oxford Dictionary.
Those who subject their kids to such a regimented, rigorous, scripted childhood are preparing a next generation of work-force that would only know how to follow the orders and accept directions.
85 % of the fortune 500 CEOs are not MBAs. And the other 15% that have an MBA, only 3 of the 15 have done MBA from an IVY LEAGUE school.
What that tells you is that too much education and scholarly childhood increases your job security, in that sense that you will never be unemployed, but it decreases the chances that you will be on the top or you will be a billionaire.
The biggest prize goes NOT TO people who can follow directions and know everything, but who can GIVE directions and get things done.

Do you know if one is better than the others...like murthy is better than rajeev khanna .....Basically who has more experience and success handling AC21 and MTR cases...I spoke to one of the murthy attorneys and they seemed to be good... but again I donot have any personal experience... Is Rajeev khanna better than murthy
No idea. It is difficult to judge them. All Attorneys are out there to get money and there is only so much to Immigration law.

I don' think they should have been rude. However they do have a point. He should NOT have shown BOTH H1b visa and AP. You can enter on one or the other.
I have entered on AP previously and my experience was very good. Only thing is you have to undergo that "secondary inspection" process where they have to verify your pending status details.
When you hand them both, you might feel you are doing it in full disclosure,
however they perceive you are not clear in your intentions. When you show them your AP, their main verification is, whether this 485 case is still open and pending. With H1b they want to know if you are working for your visa petitioning employer.
The morale of the story is, if you have availed yourself of AC21 and moved into another job, you must use AP to reenter, either that or if you moved with a H1 transfer you can use that, however, presenting your old H1b is asking for trouble. H1b is employer specific. We always need to remember that. AP is not.
I intend to travel to my home country I have H1 (not stamped but valid till 2010) working for the same sponsor if I use AP to enter US do I lose my H1 status.I have EAD but did not use it.

Ronhia, I appreciate your comments. It needs conviction, dedication and consistent efforts to make such accomplishments. Moreover it also demonstrates the character of a person, who can motivate and inspire other kids in a positive way.. especially in an environment full of negative distractions.

Yes, I called them and they said the process would generally take 30-40 days. They said, keep checking if your checks have cashed... I read in 1 message board some one posted that checks are cashed on Thursday............so tomorrow is a Thursday :D
