I DID NOT pay the huge fee.
I think they had given a waiver till August 21 or so for the July fiasco filers.
Do you think I still not have to pay or should I pay the fee ?

How can ur case be preadjudicated, yet not assigned to an officer. For my wife's case wea re told several times that her case is not preadjudicated but is with an officer. My case is approved and the officer I talked to said that it seems that her case is with the same officer who approved my case...and that her case is pending possibly becoz of biom issues on my and her case...she said she is sending a request to upload the biom again...wait for 2 weeks...not sure if there will be any positive result but what can we do other that WAIT

As of May 2007, USCIS reported a staggering 329,160 FBI name check cases pending, with approximately 64 percent (211,341) of those cases pending more than 90 days and approximately 32 percent (106,738) pending more than one year.
While the percentages of long-pending cases compared to last year are similar, the absolute numbers have increased. There are now 93,358 more cases pending the name check than last year. Perhaps most disturbing, there are 31,144 FBI name check cases pending more than 33 months as compared to 21,570 last year – over a 44 percent increase in the number of cases pending more than 33 months. The backlog appears likely to get worse, because a USCIS fee increase -- slated to take effect in July -- has prompted a 50 percent rise in new naturalization applications so far this year. I am really shocked to see that several of us in our community are still ignorant about the magnamity of the Green card situation.
Just this morning, I was talking to one my friend urging him to participate actively in the IV efforts and the answer I got was, "What for? , now that my I-485 is filed, I should get my greencard in a year." His PD is April 2006.

people applied in 2006 got their GCs. one of collegue ROW got when applied in 2007.
dont know whom to blame. why cant they understand our problems.

I received my EAD last month. But no AP yet. However, i received an email from my lawyer today that.....my AP got rejected. The rejection letter is saying that I485 got approved that's why the I131 is rejected.....therefore, my lawyer is waiting for the I485 approval.....but my lawyer told me that I can expect my card soon.
I don't know how to react. The online doesn't have any update about the I485 status yet. They received my application on July 2, 2007.

May be this is not a prediction thread. But the OP and some others are all about VB in another thread or two. While I personally dont have any issue with it, it just frustates me that people dont understand that VB is not going to do any magic for PD's in 2003 or later. C mon Lets be realistic. After doing all the math in so many threads, Does any one expect that the PD will be some where in the ending of 2003. Hell no. Then why is that we have a Dec Bulletin thread way back? Now some one is gonna come start a Jan prediction thread. Useless. We got heavy weights here supporting this bill... Kennedy and Schumer.. IV fights for all immigration issues, but not for this... then whom IV fighting for???
One can see from these posts how one feels when they see a little 'Hope' and 'Help' coming their way when its needed the most and how desparate they are to get involved for this fight ! Even though, In past we have seen some thing similar leaving us at where we were, we were happy to see that someone with us and fighting for us! Disappointed, disheartened and frustrated, we looked forward and now here its again ! -A hope of help !
IV core members must be having into their own games to help the community and can't blame them for not supporting this bill. But It would be a huge mistake if IV doesn't support it- if it has EB Visa recapture and not just for Family.

What is your take on all these bills.. I am sure you have much more info. Do you see any hope of EB relief in 2009?
There is growing pessimism in EB community.
We have some rough plans for 2009.
We need to wait for some time to see how immigration bill becomes a priority. We anticipate some more placeholder bills that will make a statement. However in the end, there will have to be a bi-partisan effort and strong will to write a CIR. I feel economy will take priority initially but they will have to look at immigration sooner than later. Admin fixes is another possibility we see. While the EB2 India and China are now getting direct benefit from horizontal spillovers, in 2009 we need to meet again with the administration and make a good case about EB3 India, China and EB3ROW backlogs. The problem seems to be increasing due to limited visas per year. This is the reason dates have not been moving. Several Other small items for admin fixes are also in brainstorming stage. Like We want to address processing delays on all applications for all categories, do something to protect the rights of immigrants, etc.
We also want to involve more members who got their greencards or immigrants who are now citizens on IV. We want suggestions from members how we can do that and get their support for this cause.
I am sure with the new initiatives you will love Immigrationvoice more and want to come to IV everyday.
At your end, please try to spread the word about IV. We can be successful in all our initiatives only if we can get more participation. Thus we need to get more EB India, china and ROW members in the IV fold. This must be our top priority early this year before we launch our big campaigns.
We look to members reading this post to help us reach out to their friends and introduce IV to them. We have well meaning intentions for everyone in every category and country and want to help and bring relief. It is important that we come together on IV and make a united effort to end our common immigration problems.

there is no rule defining any length of period that you are required to stay with Gc employer but most people recommend 6 months mainly because of possible questions at citizenship interview.
If you have a very good reason to change jobs sooner than that then document it and be prepared to defend your actions if you plan to apply for citizenship.
I dont see any reason why this would affect spouse.

I got EB2 140 approval (I have BS + 5 years of experience)
This is becoming very hard now especially at Nebraska. just wanted those sending applications now to know that Nebraska has recently rejected hundreds of (i) EB2 cases with x yrs of experience + BS even when x is 10 and (ii) EB-1 cases even with Ph.Ds (this accding to my lawyer.)

My question is
what are the ramifications if
1. I apply for i-485 now.
2. get married and bring spouse on h4 and she remains on h4
and my I485 is approved before the PD is current so spouse is out of status for a short while before she can apply for AOS?

I got an e mail from customer service this morning stating they had forwarded my letter to upper management.
It(this issue) definitely got to their attention loud and clear, and hopefully it will have an impact of both sensitizing them to this separation in the future as well as prompting them to give our issue more coverage going forward. Perhaps I am being optimistic here, but one can only hope.
