Guys if you compare the way people live and spend in India, I think they are more well off then we are. I know some friends here, all they do is, look for coupons. They�ll fight all day with Customer care reps for $1 extra that company charged, they don�t leave tips when they eat out and they eat out once in 6 months. Except for a Camry and a leather chair may be a better bed, what is this guy doing better than he would have done in India. Atleast there he had a �Kamwaali� who did the cleaning for his family. He had a tutor who taught his daughter. Here in US all he�s doing is cleaning bathrooms, kitchen their his children ad driving his Camry.

There is one more option for you. H1 and L1 employees can go on long paid/unpaid leaves. If her company can support with document that she was on an unpaid leave for any reason (I do not know the reasons...make something) then there are chances that she will be able to change her status back to H4. All you have to prove that there was a good faith employee employer relationship for that particular duration. Talk to a lawyer, explain the situation..........every passing day is making your situation worse. Good Luck.

Guys,
I am also close to situation 3.a but I changed my GC sponsered employer and working for other good and stable company using AC21.
I would like to start a company and do a side business.
What you recommend - registering it on my is good idea or on spouse's name?
If I register it on my name and generate a profit - is it going to impact my 485 as I already invokded AC21? (again I will be working in simialr job as a FT)
Any sugessions would be great help.

If you are on 3a, you have neither used AC21 nor have you left your full time job (FT job that aligns with your LC). On EAD, you can do any number of jobs (ex: you can even work 2 part time jobs totally unrelated to your LC requirements ofcourse as long as you continue to be with your GC employer). Using this rationale, you should be fine starting a business and making profit in the part time.
In fact even those who were in 3 b were able to get their GC after an interview (Search for posts by the user "unitednations"). But, it's risky and best avoided.
Personally, I want to get into 3 a, but my 140 is still pending. I plan to approach my company to switch me to EAD as soon as my 140 gets approved.

2 year back my I-140 got rejected due to same reason 3+2 degree. I have 3 years Bsc in Computer science and 2 years Master of Computer Mgmt. They raise the question on 3 year Bachealor dagree. My lawyer send the reply along with degree evaluation and we try to say my 3+2 equal to 4+2 of USA and USCIS didn't buy this argument. after that lawyer told me that no hope in MTR or appeal. So we file again in Eb3.
Now i see based on your reply if have taken this approach in appeal then i might have got approval in appeal.
uscis works in funny ways (as we all know). As I stated in earlier post one case in nebraska i know got rejected and they stated that the appeals decision wasn't precedent. The texas cases received rfe's but got approved based on the decision.
Just yesterday, I received 140 denial from texas where they didn't even discuss the decision and just picked on that bachelors was three year degree.

Sorry to hear this. Regarding medical insurance, your company has to offer you COBRA..you will end up paying almost twice the premium that you have been paying so far, but it would still be better than you footing the delivery charges (10k - 25K). Continue CORBA atleast till the deliver and post-partum - for as long as possible..
Terminating you in your ninth month pregnancy is probably against the law, i think if you can prove it, you might be able to sue your employer, check your local state laws..

it is the job profile that dictates whether the case is eb2 or eb3 - the applicant should meet the criteria for the job. not the other way around.
My advice to most people who do not perfectly fit into eb2 is to do the eb3 petition first (which is guaranteed to be approved). Get your place in line for the greencard.
If it is taking too long then you can try an eb2 later; if it gets approved then you will get the old priority date. If it doesn't; well you can say you tried but you didn't lost your place in line for the greencard because you still have the old eb3 in place.
However, if your cases is not clear for eb2 and you try this first and it gets denied then you will lose valuable time in line for the greencard because you have to start from the beginning.
Since, last august DOL has become weird with even approving eb3 labors. Generally, attornies will put language in the eta 9089 that they will accept three years of experience for each year of bachelors degree missing (this is in line with education evaluators and uscis).
However, this isn't the same criteria DOL uses. They will state that if a person doesn't have a degree then you are willing to accept 12 years of experience which is excessive and they deny the labor (before they were giving hard time to eb2 but not it is eb3 that they are after). Well we desis can only follow the lead of firingis.. so firingis say that who the f*** asked you to come here in the first place and we understand their logic and tell ourselves who the f*** asked us to be here in the first place .. so we are to blame ourselves for everything and take the crap anyway..
But that is not the point.
The point is that me and my company and you and your organisation have paid a service fee with a reasonable expectation of service. reasonable expectation of service is subject to interpretetion based on common sense and no f**king common sense says that waiting 10 years for GC is reasonable .. unless your common sense has been replaced by self disrepecting logic ....
i am not a lawyer but i think that when you pay a processing fees to apply for a privilege (drivers license, business permit, visa, green card etc) from the appropriate statutory authority (DMV, USCIS, Dept of Commerce etc) - the payment of fees does not make you the customer of the statutory authority - so to the extent that USCIS has not broken a law to discriminate against a particular set of applicants (class) - a class action may indeed have no merit.
However, if it can be proved that there has indeed been gross negligence or that USCIS has not followed its own established procedures, made commitments but not honored those, lied or broken the law of the land - then there may be a case.......
another angle is that if the law itself violates the constitution - there is a separate procedure to appeal against such a law (like may suits going on in state courts on laws related to gay rights) - however USCIS would not be party to such a lawsuit since USCIS does not make laws. one would need not only a good immigration lawyer but also a constitutional expert for a venture like this.

Go for 485, if you are not sure of your documents. I know someone who went there and who is still waiting due to Retrogression of dates to enter USA.
It is good for someone who does not mind staying outside of USA indefinately.

Sorry to hear about your experience. I personally have used AP three times within one year. Two trips to India were of 6 weeks and 4 weeks duration and one to Canada for 4 days. I have never faced any problem, having used three different entry points. During my latest entry just a couple of weeks back I wasn't even asked any question at all. In fact my GC was approved while I was out of the country. Just your bad luck to run into this officer, I guess.
